  1.1                          A bill for an act 
  1.2             relating to the University of Minnesota; providing for 
  1.3             the selection of candidates for the board of regents; 
  1.4             providing for associate regents; amending Minnesota 
  1.5             Statutes 1996, section 137.0245, subdivisions 3, 4, 
  1.6             and by adding a subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1996, section 137.0245, 
  1.9   subdivision 3, is amended to read: 
  1.10     Subd. 3.  [DUTIES.] The advisory council shall: 
  1.11     (1) develop, in consultation with current and former 
  1.12  regents and the administration of the University of Minnesota, a 
  1.13  statement of the selection criteria to be applied and a 
  1.14  description of the responsibilities and duties of a regent, and 
  1.15  shall distribute this to potential candidates; and 
  1.16     (2) for each position on the board, identify and recruit 
  1.17  qualified candidates for the board of regents, based on the 
  1.18  background and experience of the candidates, and their potential 
  1.19  for discharging the responsibilities of a member of the board of 
  1.20  regents. 
  1.21     The council shall not base its recommendations on an 
  1.22  allocation of regents to congressional districts.  The council 
  1.23  shall not consider a person's status as a student in making a 
  1.24  recommendation. 
  1.25     Sec. 2.  Minnesota Statutes 1996, section 137.0245, 
  1.26  subdivision 4, is amended to read: 
  2.1      Subd. 4.  [RECOMMENDATIONS.] The advisory council shall 
  2.2   recommend at least two and not more than four candidates. for 
  2.3   each position.  With regard to four positions, at least one in 
  2.4   each odd-numbered year, the council shall submit its 
  2.5   recommendations to the governor who shall select one person from 
  2.6   among those submitted and recommend that person's election by 
  2.7   the legislature.  With regard to the other positions the council 
  2.8   shall submit its recommendations directly to the legislature.  
  2.9   By March 15 of each odd-numbered year, the advisory council 
  2.10  shall submit its recommendations to the governor, the president 
  2.11  of the senate and the speaker of the house of representatives.  
  2.12  The legislature shall not be bound by these recommendations. 
  2.13     Sec. 3.  Minnesota Statutes 1996, section 137.0245, is 
  2.14  amended by adding a subdivision to read: 
  2.15     Subd. 4a.  [STUDENT AND FACULTY REPRESENTATION.] The board 
  2.16  of regents shall establish methods for the election of one 
  2.17  associate regent from among the faculty of the university and 
  2.18  one from among its students.  The associate regents shall act as 
  2.19  regents in all matters except that they shall not vote. 
  2.20     Sec. 4.  [EFFECTIVE DATE.] 
  2.21     This act shall apply to regents and associate regents to be 
  2.22  elected in 1999 and thereafter.
