  1.1                          A bill for an act 
  1.2             relating to energy; creating a task force to conduct a 
  1.3             study of aboveground storage tank secondary 
  1.4             containment methods. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [STUDY.] 
  1.7      The commissioners of the department of public service and 
  1.8   the pollution control agency shall appoint a nine-member task 
  1.9   force to study aboveground storage tank secondary containment 
  1.10  methods.  The task force shall include four members of the 
  1.11  petroleum industry, the commissioner of the department of public 
  1.12  service, or appointed designee, and four members designated by 
  1.13  the commissioner of the pollution control agency. 
  1.14     The task force shall make recommendations on appropriate 
  1.15  secondary containment methods to the commissioners of the 
  1.16  department of public service and the pollution control agency by 
  1.17  December 31, 1997.  These recommendations shall be considered by 
  1.18  the pollution control agency when granting a general operating 
  1.19  permit. 
  1.20     The task force shall also discuss opportunities to 
  1.21  interface with the United States Environmental Protection 
  1.22  Agency's aboveground storage tank rulemaking process.  The task 
  1.23  force shall provide a risk assessment, including a cost and 
  1.24  benefit analysis of all available secondary containment methods 
  1.25  and any disruption these methods may cause in petroleum product 
  2.1   distribution, as part of the report.  
  2.2      The commissioner of the pollution control agency shall 
  2.3   grant temporary operating permits to aboveground storage tank 
  2.4   facilities whose permits expire on July 1, 1998, if the facility 
  2.5   operators agree to comply with the American Petroleum Institute 
  2.6   653 standard for tank inspection, repair, alteration, and 
  2.7   reconstruction.  
  2.8      A copy of the task force's report shall be forwarded to the 
  2.9   chair of the senate committee on jobs, energy, and community 
  2.10  development and the chair of the house committee on regulated 
  2.11  industries and energy by January 1, 1998.
