  1.1                          A bill for an act 
  1.2             relating to land use; precluding the termination of 
  1.3             lawful land uses by amortization; amending Minnesota 
  1.4             Statutes 1998, sections 394.21, by adding a 
  1.5             subdivision; and 462.357, by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 394.21, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 1a.  [AMORTIZATION PROHIBITED.] A county, regardless 
  1.10  of population, under this chapter or under a special or local 
  1.11  law, must not enact, amend, or enforce an ordinance providing 
  1.12  for the elimination or termination of a use by amortization 
  1.13  which use was lawful at the time of its inception. 
  1.14     Sec. 2.  Minnesota Statutes 1998, section 462.357, is 
  1.15  amended by adding a subdivision to read: 
  1.16     Subd. 1c.  [AMORTIZATION PROHIBITED.] A municipality must 
  1.17  not enact, amend, or enforce an ordinance providing for the 
  1.18  elimination or termination of a use by amortization which use 
  1.19  was lawful at the time of its inception. 
  1.20     Sec. 3.  [EFFECTIVE DATE.] 
  1.21     Sections 1 and 2 are effective the day after their final 
  1.22  enactment.
