  1.1                          A bill for an act 
  1.2             relating to education; modifying the school enrichment 
  1.3             partnership program; appropriating money; amending 
  1.4             Minnesota Statutes 1998, section 124D.90. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1998, section 124D.90, is 
  1.7   amended to read: 
  1.8      124D.90 [SCHOOL AND COMMUNITY ENRICHMENT PARTNERSHIP 
  1.9   PROGRAM.] 
  1.10     Subdivision 1.  [ESTABLISHMENT.] The school and community 
  1.11  enrichment partnership program is established.  The purpose of 
  1.12  the program is to encourage districts to expand the involvement 
  1.13  of the community and the private sector in by establishing 
  1.14  academic booster clubs to support the delivery of academic 
  1.15  programs.  The program will provide matching state funds for 
  1.16  those provided by the private sector resources. 
  1.17     Subd. 2.  [REVENUE ELIGIBILITY.] A district or group of 
  1.18  districts is eligible to receive state aid a grant under this 
  1.19  program.  Districts may enter into joint agreements to provide 
  1.20  programs or make expenditures under this section.  The 
  1.21  limitations under this subdivision apply to these programs or 
  1.22  expenditures as if they were operated by a single district.  A 
  1.23  district may receive $1 of state aid for each $2 raised from the 
  1.24  private sector a one-time grant to establish a booster club.  
  1.25  The grant must be matched by funds from private sources.  The 
  2.1   private match must be in the form of cash.  Specific types of 
  2.2   noncash support may be considered for the private match.  State 
  2.3   aid A grant is limited to the lesser of $75,000 or $10 per pupil 
  2.4   unit per district $10,000 per district or $5,000 per school site.
  2.5      Subd. 3.  [REVENUE MANAGEMENT.] The use of the state and 
  2.6   private funds provided under this section is under the general 
  2.7   control of the board in consultation with the academic booster 
  2.8   club.  The board may establish, without using state funds or 
  2.9   public employees, a separate foundation to directly manage the 
  2.10  funds.  The private funds must be used to acquire 
  2.11  instructional or noninstructional academic materials of a 
  2.12  capital nature including, but not limited to, textbooks, globes, 
  2.13  maps, and other academic material to support student learning 
  2.14  and participation in the academic league under section 124D.94, 
  2.15  subdivision 4.  The funds shall not be used for salaries or 
  2.16  other employee benefits. 
  2.17     Subd. 4.  [PROCEDURES; REPORT.] The Minnesota academic 
  2.18  excellence foundation, under the direction of the commissioner 
  2.19  must establish application forms, guidelines, procedures, and 
  2.20  timelines for the distribution of state aid a grant.  The 
  2.21  commissioner may require reporting necessary to evaluate the 
  2.22  program.  Measures of success will include numbers of 
  2.23  partnerships and funds raised; numbers of academic booster clubs 
  2.24  or school foundations formed; numbers of volunteers engaged; 
  2.25  increased numbers of students participating in academic league 
  2.26  activities under section 124D.94, subdivision 4; number of 
  2.27  academic booster clubs sustained after five years; and 
  2.28  demonstrated linkages of partnerships to improved instructional 
  2.29  delivery resulting in increased student learning. 
  2.30     Subd. 5.  [RESULTS-ORIENTED CHARTER SCHOOLS.] 
  2.31  Notwithstanding section 124D.11, subdivision 6, paragraph (b), a 
  2.32  results-oriented charter school is eligible to participate in 
  2.33  the program under this section as if it were a district. 
  2.34     Sec. 2.  [APPROPRIATION.] 
  2.35     $3,500,000 in fiscal year 2000 is appropriated from the 
  2.36  general fund for the purposes of section 1.  $3,000,000 of this 
  3.1   amount is for school districts to establish academic booster 
  3.2   clubs.  $500,000 of this amount is for the Minnesota Academic 
  3.3   Excellence Foundation to provide technical assistance and 
  3.4   materials to districts participating in the school and community 
  3.5   enrichment partnership program.  Any balance in the first year 
  3.6   does not cancel but is available in the second year.
