  1.1                          A bill for an act 
  1.2             relating to the iron range resources and 
  1.3             rehabilitation board; regulating board membership; 
  1.4             amending Minnesota Statutes 2000, section 298.22, 
  1.5             subdivision 2. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 298.22, 
  1.8   subdivision 2, is amended to read: 
  1.9      Subd. 2.  [IRON RANGE RESOURCES AND REHABILITATION BOARD.] 
  1.10  There is hereby created the iron range resources and 
  1.11  rehabilitation board, consisting of 13 members, five of whom are 
  1.12  state senators appointed by the subcommittee on committees of 
  1.13  the rules committee of the senate, and five of whom are 
  1.14  representatives, appointed by the speaker of the house of 
  1.15  representatives.  The remaining members shall be appointed one 
  1.16  each by the senate majority leader, the speaker of the house of 
  1.17  representatives, and the governor and must be nonlegislators who 
  1.18  reside in a tax relief area as defined in section 273.134.  The 
  1.19  members shall be appointed in January of every odd-numbered 
  1.20  year, except that the initial nonlegislator members shall be 
  1.21  appointed by July 1, 1999, and shall serve until January of the 
  1.22  next odd-numbered year.  Vacancies on the board shall be filled 
  1.23  in the same manner as the original members were chosen.  At 
  1.24  least a majority of the legislative members of the board shall 
  1.25  be elected from state senatorial or legislative districts: 
  2.1      (1) in which over 50 percent of the residents reside within 
  2.2   a tax relief area as defined in section 273.134; or 
  2.3      (2) if a majority cannot be obtained under the criteria in 
  2.4   clause (1), then at least a majority of the legislative members 
  2.5   shall be selected from senatorial or legislative districts that 
  2.6   have the greatest percentage of residents residing within a tax 
  2.7   relief area as defined in section 273.134. 
  2.8   All expenditures and projects made by the commissioner of iron 
  2.9   range resources and rehabilitation shall first be submitted to 
  2.10  the iron range resources and rehabilitation board for approval 
  2.11  by a majority of the board of expenditures and projects for 
  2.12  rehabilitation purposes as provided by this section, and the 
  2.13  method, manner, and time of payment of all funds proposed to be 
  2.14  disbursed shall be first approved or disapproved by the board.  
  2.15  The board shall biennially make its report to the governor and 
  2.16  the legislature on or before November 15 of each even-numbered 
  2.17  year.  The expenses of the board shall be paid by the state from 
  2.18  the funds raised pursuant to this section. 
  2.19     Sec. 2.  [EFFECTIVE DATE.] 
  2.20     Section 1 is effective January 1, 2003, and applies to 
  2.21  appointments to the iron range resources and rehabilitation 
  2.22  board made on and after that date.
