  1.1                          A bill for an act 
  1.2             relating to education; establishing a citizen's regent 
  1.3             candidate advisory council; removing the requirement 
  1.4             for a student on the University of Minnesota board of 
  1.5             regents; appropriating money; amending Minnesota 
  1.6             Statutes 1996, section 137.0245; repealing Minnesota 
  1.7             Statutes 1996, section 137.023. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1996, section 137.0245, is 
  1.10  amended to read: 
  1.11     137.0245 [CITIZEN'S REGENT CANDIDATE ADVISORY COUNCIL.] 
  1.12     Subdivision 1.  [ESTABLISHMENT.] A citizen's regent 
  1.13  candidate advisory council is established to assist the governor 
  1.14  and legislature in determining criteria for, and identifying and 
  1.15  recruiting qualified candidates for membership on the board of 
  1.16  regents. 
  1.17     Subd. 2.  [MEMBERSHIP.] The citizen's regent candidate 
  1.18  advisory council shall consist of 24 members.  Twelve Four 
  1.19  members shall be appointed by the subcommittee on committees of 
  1.20  the committee on rules and administration of the senate.  Twelve 
  1.21  Four members shall be appointed by the speaker of the house of 
  1.22  representatives.  Eight members shall be appointed by the 
  1.23  governor.  Eight members shall be appointed by the combined 
  1.24  boards of the University of Minnesota alumni association and the 
  1.25  University of Minnesota Foundation.  No more than one-third two 
  1.26  of the members appointed by each appointing authority may 
  2.1   be current or former legislators and none shall be current 
  2.2   legislators.  No more than two-thirds of the members appointed 
  2.3   by each appointing authority may belong to the same political 
  2.4   party; however, Political activity or affiliation is not 
  2.5   required for the appointment of any member and shall not be used 
  2.6   as a criteria.  Geographical representation must be taken into 
  2.7   consideration when making appointments.  Section 15.0575 shall 
  2.8   govern the advisory council, except that the members shall be 
  2.9   appointed to six-year terms with one-third appointed each 
  2.10  even-numbered year.  
  2.11     Subd. 3.  [DUTIES.] The citizen's advisory council shall: 
  2.12     (1) develop, in consultation with current and former 
  2.13  regents and the administration of the University of Minnesota, a 
  2.14  comprehensive and detailed statement of the selection criteria 
  2.15  to be applied, which shall pertain to an ability to govern and 
  2.16  serve the university with excellence, and a description of the 
  2.17  responsibilities and duties of a regent, and shall distribute 
  2.18  this to potential candidates; and 
  2.19     (2) for each position on the board, identify 
  2.20  and continually recruit qualified candidates for the board of 
  2.21  regents, based on the background and experience of the 
  2.22  candidates, and their potential for discharging the 
  2.23  responsibilities of a member of the board of regents.; and 
  2.24     (3) establish plans for the ongoing development of a 
  2.25  regent's skills, knowledge, and understanding of the University 
  2.26  of Minnesota. 
  2.27     Subd. 4.  [RECOMMENDATIONS.] As necessary, the citizen's 
  2.28  advisory council shall recommend at least two and not more than 
  2.29  four candidates one candidate for each position on the board of 
  2.30  regents.  By March 15 February 1 of each odd-numbered year, 
  2.31  the citizen's advisory council shall submit its recommendations 
  2.32  to the president of the senate and the speaker of the house of 
  2.33  representatives.  The legislature shall not be bound by these 
  2.34  recommendations governor. 
  2.35     Subd. 4a.  [GOVERNOR'S DUTIES.] Upon review of the 
  2.36  citizen's advisory council's recommendations, the governor shall:
  3.1      (1) approve the recommendation and submit it to the 
  3.2   president of the senate and the speaker of the house of 
  3.3   representatives; or 
  3.4      (2) disapprove the recommendation and return it to the 
  3.5   citizen's advisory council with the reasons for disapproval in 
  3.6   writing and a request for a new recommendation. 
  3.7      Subd. 4b.  [WITHDRAWN RECOMMENDATIONS.] If the governor 
  3.8   withdraws approval of a recommendation made under subdivision 
  3.9   4a, clause (1), the governor shall return the recommendation to 
  3.10  the citizen's advisory council with the reasons for withdrawal 
  3.11  in writing and a request for a new recommendation, and the 
  3.12  council shall make a new recommendation to the governor. 
  3.13     Subd. 5.  [SUPPORT SERVICES.] The legislative coordinating 
  3.14  commission office of the governor shall provide administrative 
  3.15  and support services for the advisory council. 
  3.16     Sec. 2.  [TRANSITION OF COUNCIL MEMBERS.] 
  3.17     Terms of all current members of the regent candidate 
  3.18  advisory council are terminated on June 30, 1997.  By July 1, 
  3.19  1997, the appointing authorities shall make their appointments 
  3.20  to the citizen's regent candidate advisory council.  These 
  3.21  appointments may include current council members. 
  3.22     Sec. 3.  [APPROPRIATION.] 
  3.23     $50,000 in fiscal year 1998 and $50,000 in fiscal year 1999 
  3.24  is appropriated from the general fund to the commissioner of 
  3.25  finance.  The commissioner shall transfer to the citizen's 
  3.26  regent candidate advisory council the amounts necessary for 
  3.27  costs related to its duties under Minnesota Statutes, section 
  3.28  137.0245, and for reimbursing expenses incurred by the office of 
  3.29  the governor in providing administrative and support services. 
  3.30     Sec. 4.  [REPEALER.] 
  3.31     Minnesota Statutes 1996, section 137.023, is repealed.
