relating to state government; establishing an Americans with Disabilities Act
Notice to Businesses Working Group; requiring a report.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

WORKING GROUP.

new text begin The Americans with Disabilities Act Notice to Businesses
Working Group is established to develop recommendations for providing notice to business
owners that standard building code inspections, plan reviews, and approvals do not guarantee
complete compliance with the accessibility requirements of the Americans with Disabilities
Act, the Minnesota Human Rights Act, or state building codes.

new text begin (a) The working group shall consist of 13 members as follows:

new text begin (1) one member appointed by the Minnesota Department of Human Rights;
new text end

new text begin (2) one member appointed by the Minnesota State Council on Disability;
new text end

new text begin (3) one member appointed by the Association of Minnesota Building Officials;
new text end

new text begin (4) one member appointed by the League of Minnesota Cities;
new text end

new text begin (5) one member appointed by the Association of Minnesota Counties;
new text end

new text begin (6) one member appointed by the American Society of Civil Engineers;
new text end

new text begin (7) one member appointed by the American Institute of Architects;
new text end

new text begin (8) one member appointed by the American Society of Landscape Architects;
new text end

new text begin (9) one member appointed by the Minnesota Chamber of Commerce;
new text end

new text begin (10) one member appointed by the National Federation of Independent Business;

new text begin (11) one member appointed by the MetroIBA;

new text begin (12) one member appointed by the Minnesota Disability Law Center; and

new text begin (13) the commissioner of labor and industry or a designee.

new text begin (b) Any public member may designate a substitute from the same organization to replace
that member at a meeting of the working group.

new text begin The working group must develop recommendations to determine:
new text end

new text begin (1) the content, form, and timing of the notice; and
new text end

new text begin (2) the appropriate entity or entities responsible for providing the notice.

new text begin Administrative support. new text end

new text begin The commissioner of labor and industry shall provide
administrative support and meeting space for the working group.

new text begin Compensation. new text end

new text begin Members of the working group serve without compensation
and shall not be reimbursed for expenses.

new text begin Chair. new text end

new text begin The commissioner of labor and industry or the commissioner's designee
shall serve as chair of the working group.

new text begin Meetings. new text end

new text begin The working group shall meet as necessary and at the call of the
chair. Meetings of the working group are subject to Minnesota Statutes, chapter 13D.

new text begin Appointments; first meeting. new text end

new text begin Appointments to the working group must be
made by July 1, 2019. The commissioner of labor and industry must convene the first
meeting by August 30, 2019.

new text begin Report to legislature. new text end

new text begin By January 15, 2020, the commissioner of labor and
industry shall submit a report detailing the working group's findings and recommendations
to the chairs and ranking minority members of the committees with jurisdiction in the senate
and in the house of representatives. The report must include any draft legislation necessary
to implement the recommendations of the working group.
