  1.1                          A bill for an act
  1.2             relating to education; establishing a targeted 
  1.3             breakfast program; providing a one-time technology 
  1.4             grant to analyze the nutritional components of school 
  1.5             meals; appropriating money. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [TARGETED BREAKFAST GRANTS.] 
  1.8      Subdivision 1.  [ESTABLISHMENT.] A grant program for fiscal 
  1.9   year 1998 is established to further explore the policy of 
  1.10  providing nutritious breakfasts to public elementary school 
  1.11  children, without regard to whether the children are eligible to 
  1.12  receive free or reduced price meals, so that they can learn 
  1.13  effectively. 
  1.14     Subd. 2.  [ELIGIBILITY.] An applicant for a grant must be 
  1.15  an elementary school that participates in the federal school 
  1.16  breakfast and lunch programs.  For a school to receive a grant, 
  1.17  at least 33 percent of the lunches the school served to children 
  1.18  during the preceding school year must have been provided free or 
  1.19  at a reduced price. 
  1.20     Subd. 3.  [APPLICATION PROCESS.] To obtain a grant to 
  1.21  receive reimbursement for providing breakfasts to all children, 
  1.22  whether or not the children are from low-income families and 
  1.23  eligible to receive free or reduced price meals, a public 
  1.24  elementary school must submit an application to the commissioner 
  1.25  of children, families, and learning in the form and manner the 
  2.1   commissioner prescribes.  The application must describe how the 
  2.2   applicant will encourage all children in the school to 
  2.3   participate in the breakfast program.  The applicant also must 
  2.4   demonstrate to the commissioner that the applicant will receive 
  2.5   a $1 local match of funding or in-kind contributions for every 
  2.6   $3 of state funding the applicant receives.  The commissioner 
  2.7   may require additional information from the applicant. 
  2.8      Subd. 4.  [GRANT AWARDS.] The commissioner shall award 
  2.9   grants to the four grant recipients under Laws 1994, chapter 
  2.10  647, article 8, section 35, and then on a first-come, 
  2.11  first-served basis to all other schools that meet the 
  2.12  requirements of subdivisions 2 and 3 until funding under this 
  2.13  section is expended.  The commissioner shall determine the 
  2.14  amount of the grant using average statewide statistics and 
  2.15  individual school statistics adjusted for other state and 
  2.16  federal reimbursements.  Grant recipients must use the proceeds 
  2.17  to provide breakfasts to school children every day school is in 
  2.18  session. 
  2.19     Sec. 2.  [GRANTS TO ANALYZE THE NUTRITIONAL COMPONENTS OF 
  2.20  SCHOOL MEALS.] 
  2.21     A grant program for fiscal year 1998 is established to 
  2.22  allow school districts to purchase a computer, monitor, printer, 
  2.23  or software to analyze the nutritional components of school 
  2.24  meals, ensure districts' compliance with federal dietary 
  2.25  guidelines applicable to school meals, and improve districts' 
  2.26  management of meal costs, meal program tracking, and government 
  2.27  reporting of meals served.  To obtain a grant, a district must 
  2.28  submit an application to the commissioner of children, families, 
  2.29  and learning in the form and manner the commissioner 
  2.30  prescribes.  The applicant, in the application, must describe: 
  2.31     (1) the computer hardware and software the applicant 
  2.32  requires to comply with the terms of the grant program; 
  2.33     (2) how the applicant will analyze the nutritional 
  2.34  components of school meals; 
  2.35     (3) how the applicant will use the analysis to ensure its 
  2.36  compliance with federal dietary guidelines applicable to school 
  3.1   meals; 
  3.2      (4) how the applicant will improve its management of meal 
  3.3   costs, meal program tracking, and government reporting of meals; 
  3.4   and 
  3.5      (5) the source of a $1 local match of funding or in-kind 
  3.6   contributions the applicant will receive for every $2 of state 
  3.7   funding the applicant receives. 
  3.8      The commissioner shall determine the amount of each grant 
  3.9   based upon the demonstrated needs of the applicant up to a 
  3.10  maximum of $2,000 per grant.  The commissioner shall award 
  3.11  grants on a first-come, first-serve basis to all school 
  3.12  districts that meet the requirements of this section until 
  3.13  funding under this section is expended. 
  3.14     Sec. 3.  [APPROPRIATION.] 
  3.15     Subdivision 1.  [DEPARTMENT OF CHILDREN, FAMILIES, AND 
  3.16  LEARNING.] The sums indicated in this section are appropriated 
  3.17  from the general fund to the commissioner of children, families, 
  3.18  and learning for the fiscal years designated. 
  3.19     Subd. 2.  [TARGETED BREAKFAST GRANTS.] For targeted 
  3.20  breakfast grants under section 1:

  3.23     Subd. 3.  [SCHOOL MEALS.] For technology grants to analyze 
  3.24  the nutritional components of school meals under section 2:

  3.26     Sec. 4.  [EFFECTIVE DATE.] 
  3.27     Sections 1 to 3 are effective July 1, 1997.
