  1.1                          A bill for an act 
  1.2             relating to highways; authorizing commissioner of 
  1.3             transportation to enter into contracts with tribal 
  1.4             authorities for highway maintenance, design, and 
  1.5             construction; allowing contract to include waiver of 
  1.6             immunity from suit and submission to jurisdiction of 
  1.7             state district courts; proposing coding for new law in 
  1.8             Minnesota Statutes, chapter 161. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  [161.368] [HIGHWAY MAINTENANCE, DESIGN, AND 
  1.11  CONSTRUCTION CONTRACT WITH TRIBAL AUTHORITIES.] 
  1.12     On behalf of the state, the commissioner may enter into 
  1.13  agreements with Indian tribal authorities for the purpose of 
  1.14  providing maintenance, design, and construction to highways on 
  1.15  tribal lands.  These agreements may include (1) a provision for 
  1.16  waiver of immunity from suit by a party to the contract on the 
  1.17  part of the tribal authority with respect to any controversy 
  1.18  arising out of the contract and (2) a provision conferring 
  1.19  jurisdiction on state district courts to hear such a controversy.
