  1.1                          A bill for an act 
  1.2             relating to public safety; authorizing bureau of 
  1.3             criminal apprehension to charge and collect fee for 
  1.4             background check conducted for purposes other than 
  1.5             criminal justice and dedicating proceeds to operating 
  1.6             expenses of criminal records system; allowing bureau 
  1.7             to provide children's service provider with copy of 
  1.8             criminal record of applicant for position of 
  1.9             children's service worker; amending Minnesota Statutes 
  1.10            1994, sections 299C.10, by adding a subdivision; and 
  1.11            299C.62, subdivision 4. 
  1.12  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.13     Section 1.  Minnesota Statutes 1994, section 299C.10, is 
  1.14  amended by adding a subdivision to read: 
  1.15     Subd. 4.  [FEE FOR BACKGROUND CHECK; ACCOUNT; 
  1.16  APPROPRIATION.] The superintendent shall collect a fee in an 
  1.17  amount to cover the expense for each background check provided 
  1.18  for a purpose not directly related to the criminal justice 
  1.19  system.  The proceeds of the fee must be deposited in a special 
  1.20  account in the general fund and are appropriated to the 
  1.21  commissioner to maintain and improve the quality of the criminal 
  1.22  record system in Minnesota. 
  1.23     Sec. 2.  Minnesota Statutes 1994, section 299C.62, 
  1.24  subdivision 4, is amended to read: 
  1.25     Subd. 4.  [RESPONSE OF BUREAU.] The superintendent shall 
  1.26  respond to a background check request within a reasonable time 
  1.27  after receiving the signed, written document described in 
  1.28  subdivision 2.  The superintendent's response shall be limited 
  2.1   to a statement that the background check crime information 
  2.2   contained in the document is or is not complete and 
  2.3   accurate.  The children's service provider will receive a copy 
  2.4   of the applicant's criminal record or a statement that the 
  2.5   applicant is not the subject of a criminal history record at the 
  2.6   bureau.  It is the responsibility of the service provider to 
  2.7   determine if the applicant qualifies as an employee or volunteer 
  2.8   under this section.
