A bill for an act
relating to natural resources; prohibiting the use of
unsterilized ballast water; requiring a discharge
permit; requiring rulemaking; amending Minnesota
Statutes 2004, sections 84D.01, by adding
subdivisions; 84D.12, subdivision 1; proposing coding
for new law in Minnesota Statutes, chapter 84D.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 84D.01, is
amended by adding a subdivision to read:

new text begin "Ballast water" means water and
associated solids taken on board a vessel to control or maintain
trim, draft, stability, or stresses on the vessel, without
regard to the manner in which it is carried.

Sec. 2.

Minnesota Statutes 2004, section 84D.01, is
amended by adding a subdivision to read:

new text begin "Sediments" means any matter
settled out of ballast water within a vessel.

Sec. 3.

Minnesota Statutes 2004, section 84D.01, is
amended by adding a subdivision to read:

new text begin Sterilized. new text end

new text begin "Sterilized" means the treatment
of ballast water or sediments, or both, by filtration, thermal
methods, ultraviolet light, biocides, or other technique
approved by the commissioner to destroy or remove all living
biological organisms.

Sec. 4.

new text begin [84D.105] USE AND DISCHARGE OF BALLAST WATER.

new text begin (a) A person shall not operate a vessel on the waters of
the state that contains ballast water acquired outside of the
waters of the state, unless the ballast water and any sediments
have been sterilized as required by the commissioner.

new text begin (b) A person shall not discharge ballast water or
sediments, directly or indirectly, into the waters of the state,
unless the discharge is authorized by a permit issued by the
commissioner.

new text begin (c) An application for a permit under this section must be
submitted in the manner required by the commissioner and must
contain information and an application fee as required by the
commissioner. The commissioner may establish an application fee
notwithstanding section 16A.1283.

new text begin (d) The commissioner shall establish a ballast water and
sediments inspection program that ensures aquatic invasive
species do not enter the waters of the state through the direct
or indirect discharge of ballast water or sediments.

Sec. 5.

Minnesota Statutes 2004, section 84D.12,
subdivision 1, is amended to read:


Subdivision 1.

Required rules.

The commissioner shall
adopt rules:

(1) designating infested waters, prohibited invasive
species, regulated invasive species, and unregulated nonnative
species of aquatic plants and wild animals;

(2) governing the application for and issuance of permits
under this chapter, which rules may include a fee schedule; deleted text begin and
