A bill for an act
relating to environment; requiring certain review of wastewater treatment projects
receiving financial assistance; amending Minnesota Statutes 2016, section 116.182,
subdivision 1, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2016, section 116.182, subdivision 1, is amended to read:


Subdivision 1.

Definitions.

(a) For the purposes of this section, the terms defined in this
subdivision have the meanings given them.

(b) "Agency" means the Pollution Control Agency.

(c) "Authority" means the Public Facilities Authority established in section 446A.03.

(d) "Commissioner" means the commissioner of the Pollution Control Agency.

(e) "Essential project components" means those components of a wastewater disposal
system that are necessary to convey or treat a municipality's existing wastewater flows and
loadings.

new text begin (f) "Geographic watershed" means the watershed that contains the potable water source
supplying a wastewater treatment project.

new text begin (g) "Geographic aquifer" means the aquifer that supplies the potable water supplying a
wastewater treatment project.

Metropolitan Council, an Indian tribe or an authorized Indian tribal organization; or any
other governmental subdivision of the state responsible by law for the prevention, control,
and abatement of water pollution in any area of the state.

state in the Lake Superior Basin, other than Class 7 waters and those waters designated as
outstanding resource value waters.

wilderness characteristics, unique scientific or ecological significance, exceptional recreation
value, or other special qualities that warrant special protection.

Sec. 2.

Minnesota Statutes 2016, section 116.182, is amended by adding a subdivision to
read:

new text begin After January 1, 2020, the commissioner's review
must include a review of the proper return of treated wastewater and recharge of the
geographic aquifer within the geographic watershed for all wastewater treatment projects.
