  1.1                          A bill for an act 
  1.2             relating to public safety; characterizing certain data 
  1.3             as private; reducing cost of identification card for 
  1.4             person with serious and persistent mental illness; 
  1.5             amending Minnesota Statutes 1998, sections 13.69, 
  1.6             subdivision 1; and 171.07, subdivision 3. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1998, section 13.69, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [CLASSIFICATIONS.] (a) The following 
  1.11  government data of the department of public safety are private 
  1.12  data:  
  1.13     (1) medical data on driving instructors, licensed drivers, 
  1.14  and applicants for parking certificates and special license 
  1.15  plates issued to physically handicapped persons; 
  1.16     (2) other data on holders of a disability certificate under 
  1.17  section 169.345, except that data that are not medical data may 
  1.18  be released to law enforcement agencies; 
  1.19     (3) social security numbers in driver's license and motor 
  1.20  vehicle registration records, except that social security 
  1.21  numbers must be provided to the department of revenue for 
  1.22  purposes of tax administration and the department of labor and 
  1.23  industry for purposes of workers' compensation administration 
  1.24  and enforcement; and 
  1.25     (4) data on persons listed as designated caregivers under 
  1.26  section 171.07, subdivision 11, except that the data must be 
  2.1   released to: 
  2.2      (i) law enforcement agencies for the purpose of verifying 
  2.3   that an individual is a designated caregiver; or 
  2.4      (ii) law enforcement agencies who state that the license 
  2.5   holder is unable to communicate at that time and that the 
  2.6   information is necessary for notifying the designated caregiver 
  2.7   of the need to care for a child of the license holder; and 
  2.8      (5) data relating to individuals who qualify for a reduced 
  2.9   fee for a Minnesota identification card under section 171.07, 
  2.10  subdivision 3, paragraph (c).  
  2.11     (b) The following government data of the department of 
  2.12  public safety are confidential data:  data concerning an 
  2.13  individual's driving ability when that data is received from a 
  2.14  member of the individual's family. 
  2.15     Sec. 2.  Minnesota Statutes 1998, section 171.07, 
  2.16  subdivision 3, is amended to read: 
  2.17     Subd. 3.  [IDENTIFICATION CARD; FEE.] (a) Upon payment of 
  2.18  the required fee, the department shall issue to every applicant 
  2.19  therefor a Minnesota identification card.  The department may 
  2.20  not issue a Minnesota identification card to a person who has a 
  2.21  driver's license, other than an instruction permit or a limited 
  2.22  license.  The card must bear a distinguishing number assigned to 
  2.23  the applicant, a colored photograph or an electronically 
  2.24  produced image, the full name, date of birth, residence address, 
  2.25  a description of the applicant in the manner as the commissioner 
  2.26  deems necessary, and a space upon which the applicant shall 
  2.27  write the usual signature and the date of birth of the applicant 
  2.28  with pen and ink.  Each identification card issued to an 
  2.29  applicant under the age of 21 must be of a distinguishing color 
  2.30  and plainly marked "Under-21." 
  2.31     (b) Each Minnesota identification card must be plainly 
  2.32  marked "Minnesota identification card - not a driver's license." 
  2.33     (c) The fee for a Minnesota identification card is 50 cents 
  2.34  when issued to:  a person who is mentally retarded, as defined 
  2.35  in section 252A.02, subdivision 2, or to a physically disabled 
  2.36  person, as defined in section 169.345, subdivision 2, is 50 
  3.1   cents and who presents a certification by a psychologist stating 
  3.2   that the applicant is mentally retarded; a physically disabled 
  3.3   person, as defined in section 169.345, subdivision 2, who 
  3.4   presents a certification by a physician or chiropractor stating 
  3.5   that the applicant is physically disabled; or a person with 
  3.6   serious and persistent mental illness, as described in section 
  3.7   245.462, subdivision 20, paragraph (c), who presents a 
  3.8   certification by a mental health professional stating that the 
  3.9   applicant has such an illness. 
  3.10     Sec. 3.  [EFFECTIVE DATE.] 
  3.11     Sections 1 and 2 are effective July 1, 1999.  Section 2 
  3.12  applies to Minnesota identification cards issued on or after 
  3.13  that date.
