A bill for an act
relating to education; establishing postsecondary enrollment options incentive aid;
authorizing additional aid to reimburse the cost of textbooks and equipment for
postsecondary enrollment options students; clarifying that a postsecondary
institution may charge a fee for unreturned textbooks or equipment; appropriating
money; amending Minnesota Statutes 2018, section 124D.09, subdivisions 19, 20;
proposing coding for new law in Minnesota Statutes, chapter 124D.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2018, section 124D.09, subdivision 19, is amended to read:


Subd. 19.

Fees; textbooks; materials.

new text begin (a) new text end A postsecondary institution that receives
reimbursement for a pupil under subdivision 13 may not charge that pupil for fees, textbooks,
materials, support services as defined in section 135A.16, or other necessary costs of the
course or program in which the pupil is enrolled if the charge would be prohibited under
section 123B.37, except for equipment purchased by the pupil that becomes the property
of the pupil.

new text begin (b) A postsecondary institution may apply to the commissioner of education in the form
and manner determined by the commissioner for reimbursement of the actual costs of
textbooks and equipment provided to a pupil under this subdivision. The approved cost
under this paragraph must be added to the payments to postsecondary institutions under
subdivision 13. The adjustment under this paragraph must be reduced by the amount that
the postsecondary institution receives from fees under subdivision 20, paragraph (b).

Sec. 2.

Minnesota Statutes 2018, section 124D.09, subdivision 20, is amended to read:


Subd. 20.

Textbooks; materials.

new text begin (a) new text end All textbooks and equipment provided to a pupil,
and paid for under subdivision 13new text begin or 19new text end , are the property of the pupil's postsecondary
institution. Each pupil is required to return all textbooks and equipment to the postsecondary
institution after the course has ended.

new text begin (b) A postsecondary institution may charge the student a fee for the late return or no
return of textbooks or equipment. Textbooks or equipment not returned may be charged to
the student at the used price.

AID.

new text begin (a) For fiscal year 2020 and later, a school district or charter school is eligible for
postsecondary enrollment options incentive aid equal to 50 percent of the sum of the
payments to postsecondary institutions for district pupils enrolled in courses for secondary
credit under section 124D.09.

new text begin (b) The adjustment under section 124D.09, subdivision 19, paragraph (b), must be
excluded for the purpose of calculating aid under this section.
