  1.1                          A bill for an act 
  1.2             relating to state government; merging the departments 
  1.3             of health and human services. 
  1.4   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.5      Section 1.  [ESTABLISHMENT OF DEPARTMENT OF HEALTH AND 
  1.6   HUMAN SERVICES.] 
  1.7      The department of health and human services is 
  1.8   established.  The department is headed by a commissioner 
  1.9   appointed by the governor subject to Minnesota Statutes, section 
  1.10  15.06.  The commissioner may select one deputy, one executive 
  1.11  assistant, one personal secretary, and up to four assistant 
  1.12  commissioners.  The commissioners and these employees are in the 
  1.13  unclassified service.  The commissioner may employ other 
  1.14  permanent and temporary employees in the classified service.  
  1.15     Sec. 2.  [ABOLISHMENT.] 
  1.16     The position of commissioner of human services and the 
  1.17  department of human services is abolished.  The position of 
  1.18  commissioner of health is abolished and the department of health 
  1.19  is abolished.  
  1.20     Sec. 3.  [TRANSFERS.] 
  1.21     The powers, duties, and classified employees of the 
  1.22  departments of human services and health are transferred to the 
  1.23  department of health and human services under Minnesota 
  1.24  Statutes, section 15.039. 
  2.1      Sec. 4.  [REPORTS; LEGISLATION.] 
  2.2      By November 1, 2000, the commissioner of administration 
  2.3   shall report to the legislative committees having jurisdiction 
  2.4   over health, human services, and governmental operations on 
  2.5   reorganization strategy, progress, problems, and analyses of 
  2.6   potential conflicts and overlapping jurisdiction, and any 
  2.7   proposed administrative rules under Minnesota Statutes, chapter 
  2.8   14.  The commissioner of administration, in consultation with 
  2.9   the affected agencies, house and senate staff, and the revisor 
  2.10  of statutes, shall prepare legislation for introduction in the 
  2.11  2000 session of the legislature to accomplish the purposes of 
  2.12  sections 1 to 3. 
  2.13     Sec. 5.  [EFFECTIVE DATE.] 
  2.14     Sections 1 to 3 are effective July 1, 2000.
