A bill for an act
relating to crime prevention; prohibiting speed
contests; prohibiting individuals from being
spectators at speed contests; imposing criminal
penalties; amending Minnesota Statutes 2004, section
169.13, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 169.13, is
amended by adding a subdivision to read:

new text begin Unlawful speed contest. new text end

new text begin (a) As used in this
subdivision, "speed contest" means a motor vehicle race against
another motor vehicle, a clock, or other timing device.
However, "speed contest" does not include events in which the
time to cover a prescribed route is measured, but where the
motor vehicle does not exceed the speed limits.

new text begin (b) A person who drives a motor vehicle in a speed contest
on a public roadway or who organizes or otherwise facilitates a
speed contest on a public roadway is guilty of a misdemeanor.

new text begin (c) A person who observes, watches, or otherwise acts as a
spectator to a speed contest that is illegal under this
subdivision is guilty of a petty misdemeanor.

new text begin (d) This subdivision does not apply to motor sports events
sanctioned by an appropriate entity where public roadways,
public parking lots, public driveways, and public lands,
including, but not limited to, lakes, streams, and rivers, are
temporarily closed to the public for use as a motor sports
course.

Sec. 2. new text begin EFFECTIVE DATE.

committed on or after that date.
