1.1 A bill for an act 1.2 relating to traffic regulation; changing speed limits; 1.3 amending Minnesota Statutes 1996, section 169.14, 1.4 subdivision 2; repealing Minnesota Statutes 1996, 1.5 sections 169.99, subdivision 1b; and 171.12, 1.6 subdivision 6. 1.7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.8 Section 1. Minnesota Statutes 1996, section 169.14, 1.9 subdivision 2, is amended to read: 1.10 Subd. 2. [SPEED LIMITS.] (a) Where no special hazard 1.11 exists the following speeds shall be lawful, but any speeds in 1.12 excess of such limits shall be prima facie evidence that the 1.13 speed is not reasonable or prudent and that it is unlawful; 1.14 except that the speed limit within any municipality shall be a 1.15 maximum limit and any speed in excess thereof shall be unlawful: 1.16 (1) 30 miles per hour in an urban district; 1.17 (2)6570 miles per hour on freeways and expressways, as 1.18 defined in section 160.02, subdivision 16, outside the limits of 1.19 any urbanized area with a population of greater than 50,000 as 1.20 defined by order of the commissioner of transportation; 1.21 (3) 65 miles per hour on freeways and expressways, as 1.22 defined in section 160.02, subdivision 16, within the limits of 1.23 any urbanized area with a population of greater than 50,000 as 1.24 defined by order of the commissioner of transportation; 1.25 (4) 65 miles per hour in other locations during the 1.26 daytime; 2.1 (5) 55 miles per hour in such other locationsother than2.2those specified in this sectionduring the nighttime; 2.3(4)(6) ten miles per hour inalleysalleyways; and 2.4(5)(7) 25 miles per hour in residential roadways if 2.5 adopted by the road authority having jurisdiction over the 2.6 residential roadway. 2.7 (b) A speed limit adopted under paragraph (a), 2.8 clause(5)(7), is not effective unless the road authority has 2.9 erected signs designating the speed limit and indicating the 2.10 beginning and end of the residential roadway on which the speed 2.11 limit applies. 2.12 (c) "Daytime" means from a half hour before sunrise to a 2.13 half hour after sunset, except at any time when due to weather 2.14 or other conditions there is not sufficient light to render 2.15 clearly discernible persons and vehicles at a distance of 500 2.16 feet. "Nighttime" means at any other hour or at any time when 2.17 due to weather or other conditions there is not sufficient light 2.18 to render clearly discernible persons and vehicles at a distance 2.19 of 500 feet. 2.20 Sec. 2. [REPEALER.] 2.21 Minnesota Statutes 1996, sections 169.99, subdivision 1b; 2.22 and 171.12, subdivision 6, are repealed. 2.23 Sec. 3. [EFFECTIVE DATE.] 2.24 Sections 1 and 2 are effective June 1, 1997.
