  1.1                          A bill for an act 
  1.2             relating to school districts; requiring the 
  1.3             commissioner of children, families, and learning to 
  1.4             notify school districts annually that wood treated 
  1.5             with arsenic should be treated every two years; 
  1.6             prohibiting school districts and charter schools from 
  1.7             purchasing wood treated with arsenic unless the 
  1.8             district or school commits to sealing the wood every 
  1.9             two years; appropriating money; proposing coding for 
  1.10            new law in Minnesota Statutes, chapter 121A.  
  1.11  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.12     Section 1.  [121A.305] [WOOD TREATED WITH ARSENIC; 
  1.13  SEALANT.] 
  1.14     Subdivision 1.  [NOTICE.] The commissioner shall give 
  1.15  annual notice to school districts that wood treated with 
  1.16  arsenic, inorganic arsenic, or an arsenic copper combination 
  1.17  such as chromated copper arsenate wood preservative fungicide 
  1.18  that is likely to come in contact with children should be sealed 
  1.19  every two years with a nontoxic sealant. 
  1.20     Subd. 2.  [WOOD TREATED WITH ARSENIC; PROHIBITION.] No 
  1.21  school district or charter school shall purchase wood treated 
  1.22  with arsenic, inorganic arsenic, or an arsenic copper 
  1.23  combination such as chromated copper arsenate wood preservative 
  1.24  fungicide, or any product that contains wood treated with these 
  1.25  materials, for any use in which the wood is likely to come in 
  1.26  contact with children, unless the public entity commits to, and 
  1.27  budgets for, sealing the wood with a nontoxic sealant every two 
  1.28  years. 
  2.1      Sec. 2.  [APPROPRIATION.] 
  2.2      $10,000 is appropriated in fiscal year 2001 to the 
  2.3   commissioner of children, families, and learning for grants to 
  2.4   school districts with playground equipment with wood treated 
  2.5   with arsenic, inorganic arsenic, or an arsenic copper 
  2.6   combination such as chromated copper arsenate wood preservative 
  2.7   fungicide, to offset the costs of complying with section 1.  
  2.8   This amount is added to the agency's base.
