  1.1                          A bill for an act 
  1.2             relating to education; providing for a low-income 
  1.3             concentration aid program; allowing independent school 
  1.4             district No. 279, Osseo to levy a tax to provide 
  1.5             instructional services for at-risk children; amending 
  1.6             Minnesota Statutes 1994, section 124A.032; Laws 1994, 
  1.7             chapter 647, article 8, section 41; proposing coding 
  1.8             for new law in Minnesota Statutes, chapter 124A. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1994, section 124A.032, is 
  1.11  amended to read: 
  1.12     124A.032 [ANNUAL FOUNDATION OR GENERAL EDUCATION AID 
  1.13  APPROPRIATION.] 
  1.14     There is annually appropriated from the general fund to the 
  1.15  department of education the amount necessary for general 
  1.16  education aid and low-income concentration aid.  This amount 
  1.17  shall be reduced by the amount of any money specifically 
  1.18  appropriated for the same purpose in any year from any state 
  1.19  fund.  
  1.20     Sec. 2.  [124A.226] [LOW-INCOME CONCENTRATION AID.] 
  1.21     Subdivision 1.  [AID PROGRAM.] A low-income concentration 
  1.22  aid program is established.  The purpose of the program is to 
  1.23  provide additional resources to school buildings in which the 
  1.24  concentration of children from low-income families is high 
  1.25  compared to the district-wide concentration. 
  1.26     Subd. 2.  [APPLICATION PROCESS.] In order to qualify for 
  1.27  aid, the building must be located in a district that meets the 
  2.1   following criteria: 
  2.2      (1) ten percent or more of the district's pupils are 
  2.3   eligible for free and reduced lunch as of October 1 of the 
  2.4   previous fiscal year; 
  2.5      (2) ten percent or more of the district's pupils are 
  2.6   students of color; 
  2.7      (3) the district has at least 1500 students in average 
  2.8   daily membership; and 
  2.9      (4) the district's administrative office is located in the 
  2.10  seven county metropolitan area but not in a city of the first 
  2.11  class. 
  2.12     Subd. 3.  [AID USE.] The aid must be used according to 
  2.13  Minnesota Statutes, section 124A.28.  The aid may only be used 
  2.14  in buildings in the district where the percent of children in 
  2.15  the building eligible for free and reduced lunch is at least 20 
  2.16  percent and the number of minority students is at least 20 
  2.17  percent. 
  2.18     Sec. 3.  Laws 1994, chapter 647, article 8, section 41, is 
  2.19  amended to read: 
  2.20     Sec. 41.  [OSSEO LEVY.] 
  2.21     For 1994 taxes payable in 1995 only, Independent school 
  2.22  district No. 279, Osseo, may levy a tax in an amount not to 
  2.23  exceed $500,000.  The proceeds of this levy must be used to 
  2.24  provide instructional services for at-risk children.
