  1.1                          A bill for an act 
  1.2             relating to commerce; requiring certain fire 
  1.3             protection notifications in contracts for the sale of 
  1.4             certain newly constructed residential dwellings; 
  1.5             proposing coding for new law in Minnesota Statutes, 
  1.6             chapter 325F. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [325F.243] [CONSTRUCTION OF RESIDENTIAL 
  1.9   DWELLINGS; FIRE PROTECTION NOTIFICATION.] 
  1.10     Subdivision 1.  [DEFINITIONS.] For purposes of this section 
  1.11  the following terms have the meanings given them: 
  1.12     (1) "dwelling" means a new building constructed for 
  1.13  habitation by one to four families; 
  1.14     (2) "vendee" means a purchaser of a dwelling; and 
  1.15     (3) "vendor" means a person, partnership, corporation, or 
  1.16  other legal entity that constructs dwellings for the purpose of 
  1.17  sale, including the construction of dwellings on land owned by 
  1.18  vendees. 
  1.19     Subd. 2.  [FIRE PROTECTION SYSTEM NOTIFICATION.] The vendor 
  1.20  shall provide the vendee with the notification in subdivision 3 
  1.21  at the time a purchase agreement, earnest money contract, or 
  1.22  similar contract for the purchase of a completed dwelling is 
  1.23  executed by the parties. 
  1.24     Subd. 3.  [NOTIFICATION CONTENTS.] The vendee shall 
  1.25  acknowledge in the contract or on a separate form provided by 
  1.26  the vendor that the vendee either has been given an 
  2.1   informational fire protection system brochure provided by the 
  2.2   Minnesota state fire chief's association, or has been informed 
  2.3   by the vendor that automatic fire protection sprinklers may be 
  2.4   installed in the dwelling.
