  1.1                          A bill for an act 
  1.2             relating to parks and recreation; additions to and 
  1.3             deletions from state parks; establishing a new state 
  1.4             park and deleting two state waysides; amending 
  1.5             Minnesota Statutes 1994, section 84.054, by adding a 
  1.6             subdivision; repealing Minnesota Statutes 1994, 
  1.7             section 85.013, subdivisions 13 and 20.  
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [ADDITIONS TO, DELETIONS FROM, AND DESIGNATION 
  1.10  OF NEW STATE PARKS.] 
  1.11     Subdivision 1.  [85.012] [Subd. 19.] [FORESTVILLE STATE 
  1.12  PARK, FILLMORE COUNTY.] (a) The following areas are added to 
  1.13  Forestville state park:  
  1.14     The Northwest Quarter; the West Half of the Southwest 
  1.15  Quarter; and the Northeast Quarter of the Southwest Quarter 
  1.16  EXCEPT the Southwest Quarter of the Northeast Quarter of the 
  1.17  Southwest Quarter, Section 25, Township 102 North, Range 12 
  1.18  West; and 
  1.19     That part of the Northeast Quarter of Section 7, Township 
  1.20  102 North, Range 11 West, lying south of the Root River and west 
  1.21  of an unnamed stream which traverses the east line of the 
  1.22  Southeast Quarter of said section 7 and intersects the south 
  1.23  line of said Northeast Quarter of the Northeast Quarter of said 
  1.24  Section 7 and meanders in a northerly direction through the 
  1.25  easterly half of said Northeast Quarter of the Northeast Quarter 
  1.26  of said Section 7 to its confluence with the Root River, 
  2.1   Fillmore county, Minnesota. 
  2.2      These areas are presently administered by the commissioner 
  2.3   of natural resources as a part of the Dorer memorial state 
  2.4   forest.  Notwithstanding Minnesota Statutes, section 97A.085, 
  2.5   these areas are not game refuges.  
  2.6      (b) The following area is deleted from Forestville state 
  2.7   park:  that part of the Southeast quarter of Section 7, Township 
  2.8   102 North, Range 11 West, Fillmore county, lying east of a line 
  2.9   33 feet east of the ordinary high water mark of an unnamed 
  2.10  tributary of the south branch of the Root River, containing 
  2.11  approximately 5.5 acres, more or less.  The commissioner may 
  2.12  sell this tract to the adjacent landowner at the appraised price.
  2.13     Subd. 2.  [85.012] [Subd. 25.] [GOOSEBERRY FALLS STATE 
  2.14  PARK, LAKE COUNTY.] The following area is added to Gooseberry 
  2.15  Falls state park:  Government Lot 3, Section 23, Township 54 
  2.16  North, Range 9 West, Lake county, Minnesota. 
  2.17     Subd. 3.  [85.012] [Subd. 30a.] [JOHN A. LATSCH STATE 
  2.18  PARK.] John A. Latsch state park, Winona county, which is hereby 
  2.19  renamed from John A. Latsch state wayside.  
  2.20     Subd. 4.  [85.012] [Subd. 60.] [WILLIAM O'BRIEN STATE PARK, 
  2.21  WASHINGTON COUNTY.] The following area is added to William 
  2.22  O'Brien state park:  The Northeast quarter of the Northeast 
  2.23  Quarter, the West Half of the Northeast Quarter, and that part 
  2.24  of the Northwest Quarter of the Southeast Quarter lying westerly 
  2.25  of the Soo Line Railroad right-of-way, in Section 1, Township 31 
  2.26  North, Range 20 West, Washington county, Minnesota.  
  2.27     Sec. 2.  Minnesota Statutes 1994, section 84.054, is 
  2.28  amended by adding a subdivision to read: 
  2.29     Subd. 5.  [GOOSEBERRY FALLS STATE PARK.] A state park 
  2.30  permit is not required and a fee must not be charged for motor 
  2.31  vehicle entry or parking at the Class I highway rest area 
  2.32  parking lot located adjacent to U.S. Route No. 61 and the 
  2.33  Gooseberry River at Gooseberry Falls state park.  
  2.34     Sec. 3.  [REPEALER.] 
  2.35     Minnesota Statutes 1994, section 85.013, subdivisions 13 
  2.36  and 20, are repealed.
