A bill for an act
relating to public safety; adding synthetic marijuana to the definition of
marijuana; prescribing criminal penalties; amending Minnesota Statutes 2010,
section 152.01, subdivision 9.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2010, section 152.01, subdivision 9, is amended to read:


Subd. 9.

Marijuana.

new text begin (a) new text end "Marijuana" means all parts of the plant of any species
of the genus Cannabis, including all agronomical varieties, whether growing or not; the
seeds thereof; the resin extracted from any part of such plant; and every compound,
manufacture, salt, derivative, mixture, or preparation of such plant, its seeds or resin, but
shall not include the mature stalks of such plant, fiber from such stalks, oil or cake made
from the seeds of such plant, any other compound, manufacture, salt, derivative, mixture,
or preparation of such mature stalks, except the resin extracted therefrom, fiber, oil, or
cake, or the sterilized seed of such plant which is incapable of germination.

new text begin (b) Marijuana also includes any natural or synthetic material, compound, mixture,
or preparation that contains any quantity of a substance that is a cannabinoid receptor
agonist, including, but not limited to, the following substances and their analogs, including
homologues; isomers, whether optical, positional, or geometric; esters; ethers; salts; and
salts of isomers, esters, and ethers, whenever the existence of the isomers, esters, ethers, or
salts is possible within the specific chemical designation:
