  1.1                          A bill for an act 
  1.2             relating to the city of Duluth; authorizing the 
  1.3             expenditure of certain tax increments. 
  1.4   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.5      Section 1.  [CITY OF DULUTH; EXPENDITURE OF TAX 
  1.6   INCREMENTS.] 
  1.7      Subdivision 1.  [EXPENDITURES AUTHORIZED.] Notwithstanding 
  1.8   Minnesota Statutes, section 469.1764, the Duluth economic 
  1.9   development authority may expend up to $3,000,000 of tax 
  1.10  increments collected from development district No. 3 on 
  1.11  activities located outside the geographic boundaries of the 
  1.12  district, subject to the conditions in this section. 
  1.13     Subd. 2.  [LOCATION OF EXPENDITURES.] Tax increments must 
  1.14  be spent within the area bounded by the following described 
  1.15  lines: 
  1.16     (1) to the north by a line described as follows:  beginning 
  1.17  at the intersection of the centerline of 29th Avenue West and 
  1.18  the southerly line of West Michigan Street, thence southwesterly 
  1.19  along the southerly line of West Michigan Street to the east 
  1.20  limit of the DM&IR railway right-of-way; thence northwesterly 
  1.21  along the easterly limit of the DM&IR railway right-of-way to 
  1.22  the centerline of West Superior Street to its intersection with 
  1.23  the centerline of Jenswold Street; thence southwesterly along 
  1.24  the centerline of Jenswold Street to its intersection with the 
  2.1   centerline of the Northern Pacific Railway Company's main line 
  2.2   to St. Paul; thence southwesterly along the centerline of the 
  2.3   Northern Pacific Railway Company's main line to St. Paul to its 
  2.4   intersection with the extended centerline of 37th Avenue West; 
  2.5      (2) to the west by a line described as follows:  beginning 
  2.6   at the intersection of the centerline of the Northern Pacific 
  2.7   Railway Company's main line to St. Paul and the extended 
  2.8   centerline of 37th Avenue West; then southeasterly along said 
  2.9   extended centerline of 37th Avenue West to its intersection with 
  2.10  the centerline of Interstate highway 35; 
  2.11     (3) to the south by the centerline of Interstate highway 
  2.12  35; and 
  2.13     (4) to the east by the centerline of 29th Avenue West. 
  2.14     Subd. 3.  [LIMITATIONS ON USE.] All expenditures of tax 
  2.15  increments permitted by this section must meet the requirements 
  2.16  of Minnesota Statutes, section 469.176, subdivision 4j. 
  2.17     [EFFECTIVE DATE.] This section is effective June 1, 2003.
