  1.1                          A bill for an act 
  1.2             relating to human rights; providing for access to data 
  1.3             in case files by the charging party; amending 
  1.4             Minnesota Statutes 1994, section 363.061, subdivision 
  1.5             4. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 363.061, 
  1.8   subdivision 4, is amended to read: 
  1.9      Subd. 4.  [CHARGING PARTY ACCESS.] (a) Except as provided 
  1.10  in paragraph (b), data comprised of materials and documentation 
  1.11  provided by a charging party that is part of an open or closed 
  1.12  case file is accessible to the charging party in accordance with 
  1.13  section 13.04, subdivision 3.  The charging party may consent to 
  1.14  the release of the data to the charging party's attorney or 
  1.15  other legal representative. 
  1.16     (b) The commissioner may deny access by the charging party 
  1.17  to data in an open case file if the commissioner determines that 
  1.18  release of the data would be detrimental to the investigative 
  1.19  process.  This paragraph does not apply to materials and 
  1.20  documentation provided by the charging party.
