  1.1                          A bill for an act 
  1.2             relating to crime; including convictions for malicious 
  1.3             punishment of a child within the enhanced penalty 
  1.4             provisions of the domestic assault law; amending 
  1.5             Minnesota Statutes 1998, section 609.2242, 
  1.6             subdivisions 2 and 4. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1998, section 609.2242, 
  1.9   subdivision 2, is amended to read: 
  1.10     Subd. 2.  [GROSS MISDEMEANOR.] Whoever violates subdivision 
  1.11  1 during the time period between a previous conviction under 
  1.12  this section or sections 609.221 to 609.2231, 609.224, 609.342 
  1.13  to 609.345, 609.377, or 609.713 against a family or household 
  1.14  member as defined in section 518B.01, subdivision 2, and the end 
  1.15  of the five years following discharge from sentence for that 
  1.16  conviction is guilty of a gross misdemeanor and may be sentenced 
  1.17  to imprisonment for not more than one year or to payment of a 
  1.18  fine of not more than $3,000, or both. 
  1.19     Sec. 2.  Minnesota Statutes 1998, section 609.2242, 
  1.20  subdivision 4, is amended to read: 
  1.21     Subd. 4.  [FELONY.] Whoever violates the provisions of this 
  1.22  section or section 609.224, subdivision 1, against the same 
  1.23  victim during the time period between the first of two or more 
  1.24  previous convictions under this section or sections 609.221 to 
  1.25  609.2231, 609.224, 609.342 to 609.345, 609.377, or 609.713, and 
  1.26  the end of the five years following discharge from sentence for 
  2.1   that conviction is guilty of a felony and may be sentenced to 
  2.2   imprisonment for not more than five years or payment of a fine 
  2.3   of not more than $10,000, or both. 
  2.4      Sec. 3.  [EFFECTIVE DATE.] 
  2.5      Sections 1 and 2 are effective August 1, 1999, and apply to 
  2.6   crimes committed on or after that date.
