  1.2                          A bill for an act
  1.3             relating to human services; establishing threshold 
  1.4             limits for rehabilitative and therapeutic services 
  1.5             covered under medical assistance. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [COVERAGE OF REHABILITATIVE AND THERAPEUTIC 
  1.8   SERVICES.] 
  1.9      (a) The threshold limits for fee-for-service medical 
  1.10  assistance rehabilitative and therapeutic services for calendar 
  1.11  years 1998 and 1999 shall be the limits prescribed in the 
  1.12  department of human services health care programs provider 
  1.13  manual for calendar year 1997.  Rehabilitative and therapeutic 
  1.14  services are:  physical therapy services provided to medical 
  1.15  assistance recipients pursuant to Minnesota Statutes, section 
  1.16  256B.0625, subdivision 8; occupational therapy services provided 
  1.17  to medical assistance recipients pursuant to Minnesota Statutes, 
  1.18  section 256B.0625, subdivision 8a; and speech language pathology 
  1.19  services provided to medical assistance recipients pursuant to 
  1.20  Minnesota Rules, part 9505.0390. 
  1.21     (b) The commissioner of human services, in consultation 
  1.22  with the department of human services rehabilitative work group, 
  1.23  shall report to the chair of the senate health and family 
  1.24  security committee and the chair of the house health and human 
  1.25  services committee by January 15, 1999, recommendations and 
  2.1   proposed legislation for the appropriate level of rehabilitative 
  2.2   services delivered to medical assistance recipients before prior 
  2.3   authorization.  The recommendations shall also include proposed 
  2.4   legislation to clarify the rehabilitative and therapeutic 
  2.5   benefit set for medical assistance, as well as the appropriate 
  2.6   response time for requests for prior authorization.  
  2.7      Sec. 2.  [EFFECTIVE DATE.] 
  2.8      This act is effective the day following final enactment.
