  1.1                          A bill for an act 
  1.2             relating to crime; requiring certain modifications to 
  1.3             the sentencing guidelines to ensure sentence 
  1.4             proportionality and to preserve available prison 
  1.5             resources for the most violent offenders. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [SENTENCING GUIDELINES MODIFICATIONS REQUIRED.] 
  1.8      Subdivision 1. [MODIFICATIONS REQUIRED; DEFINITIONS.] (a) 
  1.9   The sentencing guidelines commission shall modify the sentencing 
  1.10  guidelines and the sentencing guidelines grid as provided in 
  1.11  this section and shall apply the modifications to offenders who 
  1.12  commit crimes on or after August 1, 1995. 
  1.13     (b) As used in this section, "current severity level" means 
  1.14  a severity level described in the sentencing guidelines before 
  1.15  August 1, 1995; and "new severity level" means a severity level 
  1.16  created or renumbered by this section. 
  1.17     Subd. 2.  [COMBINE CURRENT SEVERITY LEVELS I AND II.] The 
  1.18  commission shall eliminate current severity level I of the 
  1.19  sentencing guidelines grid and move the offenses ranked in it to 
  1.20  current severity level II.  The commission shall renumber 
  1.21  current severity levels II to VI as new severity levels I to V. 
  1.22     Subd. 3.  [CREATE NEW SEVERITY LEVEL VI.] The commission 
  1.23  shall modify the sentencing guidelines grid by creating a new 
  1.24  severity level VI.  The new severity level VI shall include the 
  1.25  following components: 
  2.1      (1) a presumptive sentence disposition of commitment to 
  2.2   prison, regardless of criminal history score; 
  2.3      (2) a presumptive sentence duration of 36 months at zero 
  2.4   criminal history score; and 
  2.5      (3) increases in presumptive sentence duration of seven 
  2.6   months for each additional criminal history point. 
  2.7      Subd. 4.  [ADJUST INCREASES IN SENTENCE DURATION.] The 
  2.8   commission shall modify the sentencing guidelines grid to 
  2.9   provide for the following increases in presumptive sentence 
  2.10  duration for additional criminal history points: 
  2.11     (1) at new severity levels I and II:  two months for each 
  2.12  additional criminal history point; 
  2.13     (2) at new severity level III:  three months for each 
  2.14  additional criminal history point; 
  2.15     (3) at new severity level IV:  five months for each 
  2.16  additional criminal history point; 
  2.17     (4) at new severity level V:  ix months for each additional 
  2.18  criminal history point; and 
  2.19     (5) at new severity level VI:  seven months for each 
  2.20  additional criminal history point. 
  2.21     Subd. 5.  [REVERSE ORDER OF SEVERITY LEVELS ON GRID.] The 
  2.22  commission shall modify the sentencing guidelines grid to 
  2.23  display the severity levels in descending order.  Current 
  2.24  severity level X shall be displayed at the top of the grid and 
  2.25  the remaining severity levels shall descend in order to new 
  2.26  severity level I at the bottom of the grid. 
  2.27     Subd. 6.  [NEW SEVERITY LEVEL V; CRIMINAL HISTORY 
  2.28  POINTS.] The commission shall modify the sentencing guidelines 
  2.29  to assign one and one-half points for each prior felony 
  2.30  conviction ranked in new severity level V. 
  2.31     Subd. 7.  [LIMIT MISDEMEANOR AND GROSS MISDEMEANOR POINTS.] 
  2.32  (a) Except as otherwise provided in paragraph (c), the 
  2.33  commission shall modify the sentencing guidelines by restricting 
  2.34  the misdemeanor and gross misdemeanor offense list to prior 
  2.35  violent offenses and offenses against the person.  The 
  2.36  misdemeanor and gross misdemeanor offenses on the list shall be 
  3.1   limited to violations of the following:  Minnesota Statutes, 
  3.2   sections 609.563, subdivision 2 (THIRD DEGREE ARSON); 609.2231, 
  3.3   subdivisions 2, 4, 5, and 6 (FOURTH DEGREE ASSAULT); 609.224 
  3.4   (FIFTH DEGREE ASSAULT); 624.714 (UNLAWFULLY CARRYING A PISTOL); 
  3.5   641.165 (CONTRABAND ARTICLES FORBIDDEN); 609.3451 (FIFTH DEGREE 
  3.6   CRIMINAL SEXUAL CONDUCT); 609.66 (DANGEROUS WEAPONS); 609.487 
  3.7   (FLEEING A PEACE OFFICER IN A MOTOR VEHICLE); 609.749, 
  3.8   subdivision 2 (HARASSMENT; STALKING); 617.23 (INDECENT 
  3.9   EXPOSURE); 609.746 (INTERFERENCE WITH PRIVACY); 609.795 (LETTER, 
  3.10  TELEGRAM, OR PACKAGE; OPENING; HARASSMENT); 609.79 (OBSCENE OR 
  3.11  HARASSING TELEPHONE CALLS); 609.605, subdivision 2 (TRESPASS); 
  3.12  609.748 (HARASSMENT; RESTRAINING ORDER); and 518B.01, 
  3.13  subdivision 14 (ORDER FOR PROTECTION VIOLATION). 
  3.14     (b) The commission shall modify the sentencing guidelines 
  3.15  to provide that points for prior misdemeanors and gross 
  3.16  misdemeanors may be included in a felony offender's criminal 
  3.17  history score only when the offender currently is being 
  3.18  sentenced for a felony offense against the person.  As used in 
  3.19  this paragraph, "felony offense against the person" includes 
  3.20  felony violations of the following:  Minnesota Statutes, 
  3.21  sections 169.09, subdivision 14, paragraphs (a) and (b), clauses 
  3.22  (1) and (2) (ACCIDENTS); 609.687 (ADULTERATION); 609.245 
  3.23  (AGGRAVATED ROBBERY); 609.215 (AIDING SUICIDE); 609.561 (FIRST 
  3.24  DEGREE ARSON); 609.221 (FIRST DEGREE ASSAULT); 609.222 (SECOND 
  3.25  DEGREE ASSAULT); 609.223 (THIRD DEGREE ASSAULT); 609.2231, 
  3.26  subdivisions 1, 3, and 4, paragraph (b) (FOURTH DEGREE ASSAULT); 
  3.27  609.224, subdivision 4 (FIFTH DEGREE ASSAULT); 609.267 (FIRST 
  3.28  DEGREE ASSAULT OF AN UNBORN CHILD); 609.2671 (SECOND DEGREE

  4.29     (c) Notwithstanding paragraph (a), each prior violation of 
  4.30  Minnesota Statutes, section 169.121, shall count as two units in 
  4.31  the criminal history scores of persons convicted of violating 
  4.32  Minnesota Statutes, section 609.21 (CRIMINAL VEHICULAR HOMICIDE 
  4.33  AND INJURY). 
  4.34     Subd. 8.  [CHANGES IN RANKING OF CERTAIN CRIMES.] The 
  4.35  commission shall modify the sentencing guidelines and the 
  4.36  sentencing guidelines grid to provide that the following felony 
  5.1   offenses are reranked in the severity levels specified in this 
  5.2   subdivision: 
  5.3      (1) current severity level VII:  Minnesota Statutes, 
  5.4   sections 152.021 (FIRST DEGREE CONTROLLED SUBSTANCE CRIME); and 
  5.5   152.0261 (IMPORTING CONTROLLED SUBSTANCES ACROSS STATE BORDERS); 
  5.6      (2) new severity level VI:  Minnesota Statutes, sections 
  5.7   609.222 (SECOND DEGREE ASSAULT WITH FIREARM); 152.022 (SECOND 
  5.8   DEGREE CONTROLLED SUBSTANCE CRIME); 609.855, subdivision 5 
  5.9   (SHOOTING AT OCCUPIED TRANSIT VEHICLE OR FACILITY); and 609.66, 
  5.10  subdivision 1e (DRIVE-BY SHOOTING); 
  5.11     (3) new severity level V:  Minnesota Statutes, sections 
  5.12  169.09, subdivision 14, paragraph (a), clause (1) (ACCIDENTS); 
  5.13  609.344, subdivision 1, clauses (b), (e), and (f) (THIRD DEGREE 
  5.14  CRIMINAL SEXUAL CONDUCT); 609.21, subdivisions 2 and 4 (CRIMINAL 
  5.15  VEHICULAR HOMICIDE AND INJURY); 609.205, clauses (2), (3), and 
  5.16  (4) (SECOND DEGREE MANSLAUGHTER); 609.2665, clauses (2), (3),

  5.24     (4) new severity level IV:  Minnesota Statutes, sections 
  5.25  609.2671 (SECOND DEGREE ASSAULT OF UNBORN CHILD); 609.223, 
  5.26  subdivision 1 (THIRD DEGREE ASSAULT); 609.345, subdivision 1, 
  5.27  clauses (b), (e), and (f) (FOURTH DEGREE CRIMINAL SEXUAL

  6.34  New severity level II also shall include theft and theft-related 
  6.35  crimes listed in the theft offense and theft-related offense 
  6.36  lists of the sentencing guidelines, where the value of the 
  7.1   property or services exceeds $2,500; and 
  7.2      (7) new severity level I:  all offenses ranked in current 
  7.3   severity level I; and Minnesota Statutes, sections 609.525 
  7.4   (BRINGING STOLEN GOODS INTO STATE; $2,500 AND LESS); 609.52, 
  7.5   subdivision 2, clause (17) (MOTOR VEHICLE USE WITHOUT CONSENT); 
  7.6   609.526, clauses (1) and (2) (PRECIOUS METAL DEALERS; RECEIVING 
  7.7   STOLEN GOODS; $2,500 AND LESS); and 609.53 (RECEIVING STOLEN 
  7.8   GOODS; $2,500 AND LESS). 
  7.9   New severity level I also shall include theft and theft-related 
  7.10  crimes listed in the theft offense and theft-related offense 
  7.11  lists of the sentencing guidelines, where the value of the 
  7.12  property or services is $2,500 or less.  
  7.13     Felony offenses that are not listed or referred to in this 
  7.14  subdivision shall continue to be ranked in the same severity 
  7.15  level in which they were ranked before August 1, 1995. 
  7.16     Sec. 2.  [EFFECTIVE DATE.] 
  7.17     Section 1 is effective the day following final enactment.
