  1.1                          A bill for an act 
  1.2             relating to community education; providing for youth 
  1.3             programs; appropriating money; proposing coding for 
  1.4             new law in Minnesota Statutes, chapter 124D. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [124D.211] [YOUTH PROGRAMS IN COMMUNITY 
  1.7   EDUCATION.] 
  1.8      Subdivision 1.  [YOUTH PROGRAMS IN COMMUNITY EDUCATION 
  1.9   REVENUE.] (a) Each district operating a community education 
  1.10  program under section 124D.19 may establish youth programs in 
  1.11  community education to maintain and expand participation by 
  1.12  school-age youth in supervised activities during nonschool 
  1.13  hours.  The youth programs in community education revenue must 
  1.14  be used for activities that support development of social, 
  1.15  mental, physical, and creative abilities of school-age youth. 
  1.16     (b) A district's youth programs in community education 
  1.17  revenue is determined as follows: 
  1.18     (1) $8 multiplied by the greater of 1,335 or the population 
  1.19  of the district, as defined under section 275.14, not to exceed 
  1.20  10,000; and 
  1.21     (2) $2 multiplied by the population of the district, as 
  1.22  defined under section 275.14, in excess of 10,000. 
  1.23     Subd. 2.  [YOUTH PROGRAMS IN COMMUNITY EDUCATION LEVY.] To 
  1.24  obtain youth programs in community education revenue, a district 
  1.25  may levy the amount raised by .003 times the adjusted net tax 
  2.1   capacity of the district.  If the amount of youth programs in 
  2.2   community education levy exceeds the district's youth programs 
  2.3   in community education revenue, the amount of the youth programs 
  2.4   in community education levy is limited to the district's youth 
  2.5   programs in community education revenue.  If the district does 
  2.6   not levy the entire amount permitted, the youth programs in 
  2.7   community education aid must be reduced in proportion to the 
  2.8   actual amount levied. 
  2.9      Subd. 3.  [YOUTH PROGRAMS IN COMMUNITY EDUCATION AID.] A 
  2.10  district's youth programs in community education aid is equal to:
  2.11     (1) the difference between the district's youth programs in 
  2.12  community education revenue; minus 
  2.13     (2) the actual amount levied under subdivision 2. 
  2.14     Sec. 2.  [APPROPRIATION.] 
  2.15     $11,000,000 in fiscal year 2002 and $11,000,000 in fiscal 
  2.16  year 2003 are appropriated from the general fund to the 
  2.17  commissioner of children, families, and learning for youth 
  2.18  programs in community education aid under Minnesota Statutes, 
  2.19  section 124D.211, subdivision 3.
