  1.1                          A bill for an act 
  1.2             relating to health; providing for certain disclosures 
  1.3             and training in the care of Alzheimer's patients; 
  1.4             appropriating money; proposing coding for new law in 
  1.5             Minnesota Statutes, chapter 144A. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [144A.68] [ALZHEIMER'S SPECIAL CARE.] 
  1.8      Subdivision 1.  [DEFINITION.] For the purposes of this 
  1.9   section, "Alzheimer's special care unit or program" means a 
  1.10  nursing facility, residential care or assisted living facility, 
  1.11  home care licensee, home health agency, adult day care center, 
  1.12  hospice, or adult foster home that secures, segregates, or 
  1.13  provides a special program or special unit for residents with a 
  1.14  diagnosis of probable Alzheimer's disease or a related disorder 
  1.15  and that advertises, markets, or otherwise promotes the facility 
  1.16  as providing specialized Alzheimer's dementia care or memory 
  1.17  care services. 
  1.18     Subd. 2.  [DISCLOSURE.] A facility or service that offers 
  1.19  to provide or provides care for a person with Alzheimer's 
  1.20  disease through an Alzheimer's special care unit or program 
  1.21  shall disclose the following in writing to a person, or the 
  1.22  person's guardian or relative, who seeks placement in the 
  1.23  Alzheimer's special care unit or program: 
  1.24     (1) the form of care or treatment provided that 
  1.25  distinguishes the facility or service as being especially 
  2.1   applicable to, or suitable for, persons with Alzheimer's 
  2.2   disease; 
  2.3      (2) the unit or program's overall treatment philosophy and 
  2.4   mission that reflects the needs of residents afflicted with 
  2.5   dementia; 
  2.6      (3) screening, admission and discharge procedures, 
  2.7   assessment, care planning and implementation, and staffing 
  2.8   patterns and training ratios unique to the unit; 
  2.9      (4) physical environment and design features appropriate to 
  2.10  support the functioning of cognitively impaired adult residents; 
  2.11     (5) resident security features; 
  2.12     (6) the frequency and types of resident activities; 
  2.13     (7) the opportunity for involvement of families and the 
  2.14  availability of family support programs; and 
  2.15     (8) the costs of care and any additional fees unique to the 
  2.16  Alzheimer's special care unit or program. 
  2.17     Subd. 3.  [ENFORCEMENT.] At the time of licensure or 
  2.18  registration and renewal of licensure or registration, each 
  2.19  Alzheimer's special care unit or program shall provide to the 
  2.20  commissioner of human services or the commissioner of health, as 
  2.21  appropriate, a copy of the disclosures made under subdivision 
  2.22  2.  The appropriate commissioner shall require that the unit or 
  2.23  program fulfill the claims made in the disclosures under 
  2.24  subdivision 2. 
  2.25     Subd. 4.  [REQUIRED TRAINING.] Direct care staff in a 
  2.26  facility or service that offers to provide or provides care for 
  2.27  persons with Alzheimer's disease by means of an Alzheimer's 
  2.28  special care unit or program shall have four hours of 
  2.29  Alzheimer's service training within the first four weeks of 
  2.30  employment and four hours annually thereafter.  Training shall 
  2.31  include:  an overview of Alzheimer's disease and related 
  2.32  dementias; learning to communicate with an individual who is 
  2.33  unable to direct self care; providing services, including 
  2.34  problem solving, maximizing functioning, and life skills, for 
  2.35  persons with Alzheimer's disease; and providing social, 
  2.36  recreational, and rehabilitative activities for persons with 
  3.1   Alzheimer's disease. 
  3.2      Sec. 2.  [APPROPRIATIONS.] 
  3.3      (a) $....... is appropriated from the general fund to the 
  3.4   commissioner of health for the biennium beginning July 1, 2001, 
  3.5   to administer and enforce the provisions of section 1. 
  3.6      (b) $....... is appropriated from the general fund to the 
  3.7   commissioner of human services for the biennium beginning July 
  3.8   1, 2001, to administer and enforce the provisions of section 1. 
  3.9      (c) $....... is appropriated from the general fund to the 
  3.10  commissioner of human services for the biennium beginning July 
  3.11  1, 2001, for facility reimbursement or grants for dementia 
  3.12  training. 
  3.13     Sec. 3.  [EFFECTIVE DATE.] 
  3.14     Section 1 is effective January 1, 2002.
