  1.1                          A bill for an act 
  1.2             relating to family law; clarifying support withholding 
  1.3             of income from certain independent contractors in the 
  1.4             motor carrier industry; amending Minnesota Statutes 
  1.5             1998, section 518.6111, by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 518.6111, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 12a.  [INDEPENDENT CONTRACTORS IN MOTOR CARRIER 
  1.10  INDUSTRY.] If an independent contractor contracts motor carrier 
  1.11  equipment to a for-hire motor carrier with driver services which 
  1.12  the independent contractor provides personally, and if the 
  1.13  contract does not provide separately for payment for the 
  1.14  equipment and for the driving service, it must be assumed for 
  1.15  purposes of withholding income under this chapter that 30 
  1.16  percent of the contract payment is for the driving service and 
  1.17  that amount is subject to withholding.  If the independent 
  1.18  contractor does not drive the equipment personally, ten percent 
  1.19  of the contract payment is subject to withholding.  Amounts 
  1.20  withheld from the independent contractor's income must not 
  1.21  exceed the maximum permitted under the Consumer Credit 
  1.22  Protection Act, United States Code, title 15, section 1673(b)(2).
