  1.5             amending Minnesota Statutes 2002, sections 116P.09, 
  1.6             subdivision 5; 116P.13, subdivision 1; 116P.14, 
  1.7             subdivision 1. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9   Section 1.  [MINNESOTA RESOURCES.] 
  1.10     The sums shown in the columns marked "APPROPRIATIONS" are 
  1.11  appropriated from the general fund, or another named fund, to 
  1.12  the agencies and for the purposes specified in this article, to 
  1.13  be available for the fiscal years indicated for each purpose.  
  1.14  The figures "2003," "2004," and "2005," where used in this 
  1.15  article, mean that the appropriation or appropriations listed 
  1.16  under them are available for the year ending June 30, 2003, June 
  1.17  30, 2004, or June 30, 2005, respectively.  The term "the first 
  1.18  year" means the year ending June 30, 2004, and the term "the 
  1.19  second year" means the year ending June 30, 2005.

  2.30  Account (LAWCON)" means the state land 
  2.31  and water conservation account in the 
  2.32  future resources fund referred to in 
  2.33  Minnesota Statutes, section 116P.14.

  4.1   $1,764,000 is for restoration and 
  4.2   management activities in wildlife 
  4.3   management areas, wetland habitat, 
  4.4   lakes, wild rice beds, grasslands, and 
  4.5   fisheries habitat.  $1,770,000 is for 
  4.6   conservation easement programs on 
  4.7   riparian areas, big woods forests, 
  4.8   native prairies, and wetlands.  
  4.9   $2,915,000 is for habitat acquisition 
  4.10  activities on prairies, riparian areas, 
  4.11  and other fish and wildlife habitat 
  4.12  corridors.  As part of the required 
  4.13  work program, criteria and priorities 
  4.14  for planned acquisition and restoration 
  4.15  activities must be submitted to the 
  4.16  legislative commission on Minnesota 
  4.17  resources for review and approval 
  4.18  before expenditure.  Expenditures are 
  4.19  limited to the 11 project areas as 
  4.20  defined in the work program.  Land 
  4.21  acquired with this appropriation must 
  4.22  be sufficiently improved to meet at 
  4.23  least minimum habitat and facility 
  4.24  management standards as determined by 
  4.25  the commissioner of natural resources.  
  4.26  This appropriation may not be used for 
  4.27  the purchase of residential structures 
  4.28  unless expressly approved in the work 
  4.29  program.  Any land acquired in fee 
  4.30  title by the commissioner of natural 
  4.31  resources with money from this 
  4.32  appropriation must be designated:  (1) 
  4.33  as an outdoor recreation unit under 
  4.34  Minnesota Statutes, section 86A.07; or 
  4.35  (2) as provided in Minnesota Statutes, 
  4.36  sections 89.018, subdivision 2, 
  4.37  paragraph (a); 97A.101; 97A.125; 
  4.38  97C.001; and 97C.011.  The commissioner 
  4.39  may so designate any lands acquired in 
  4.40  less than fee title.  This 
  4.41  appropriation is available until June 
  4.42  30, 2006, at which time the project 
  4.43  must be completed and final products 
  4.44  delivered, unless an earlier date is 
  4.45  specified in the work program. 
  4.46  (b) Metropolitan Area Wildlife 
  4.47  Corridors 
  4.48  $7,645,000 is from the future resources 
  4.49  fund to the commissioner of natural 
  4.50  resources.  $233,000 the first year and 
  4.51  $233,000 the second year are from the 
  4.52  trust fund.  $4,916,000 of this 
  4.53  appropriation is for acceleration of 
  4.54  agency programs and cooperative 
  4.55  agreements with the Trust for Public 
  4.56  Land, Ducks Unlimited, Inc., Friends of 
  4.57  the Mississippi River, Great River 
  4.58  Greening, Minnesota Land Trust, 
  4.59  Minnesota Valley National Wildlife 
  4.60  Refuge Trust, Inc., and Minnesota 
  4.61  Waterfowl Association for the purposes 
  4.62  of planning, improving, and protecting 
  4.63  important natural areas in the 
  4.64  metropolitan region, as defined by 
  4.65  Minnesota Statutes, section 473.121, 
  4.66  subdivision 2, through grants, 
  4.67  contracted services, conservation 
  4.68  easements, and fee acquisition and is 
  4.69  available as follows:  $140,000 is for 
  5.1   program planning and coordination; 
  5.2   $1,199,000 is for habitat restoration; 
  5.3   and $3,577,000 is for land acquisition 
  5.4   and easements.  $1,966,000 of this 
  5.5   appropriation is for an agreement with 
  5.6   the city of Ramsey for the Trott Brook 
  5.7   Corridor acquisition.  $1,229,000 of 
  5.8   this appropriation is for an agreement 
  5.9   with the Rice Creek Watershed District 
  5.10  for Hardwood Creek acquisition and 
  5.11  restoration.  Land acquired with this 
  5.12  appropriation must be sufficiently 
  5.13  improved to meet at least minimum 
  5.14  management standards as determined by 
  5.15  the commissioner of natural resources.  
  5.16  As part of the required work program, 
  5.17  criteria and priorities for planned 
  5.18  acquisition and restoration activities 
  5.19  must be submitted to the legislative 
  5.20  commission on Minnesota resources for 
  5.21  review and approval before 
  5.22  expenditure.  Expenditures are limited 
  5.23  to the identified project areas as 
  5.24  defined in the work program.  This 
  5.25  appropriation may not be used for the 
  5.26  purchase of residential structures 
  5.27  unless expressly approved in the work 
  5.28  program.  Any land acquired in fee 
  5.29  title by the commissioner of natural 
  5.30  resources with money from this 
  5.31  appropriation must be designated:  (1) 
  5.32  as an outdoor recreation unit under

  5.34  (2) as provided in Minnesota Statutes, 
  5.35  sections 89.018, subdivision 2,

  5.45  (c) Restoring RIM Match 
  5.46  $369,000 the first year and $369,000 
  5.47  the second year are from the trust fund 
  5.48  to the commissioner of natural 
  5.49  resources for the RIM critical habitat 
  5.50  matching program to acquire and enhance 
  5.51  fish, wildlife, and native plant 
  5.52  habitat.  Land acquired with this 
  5.53  appropriation must be sufficiently 
  5.54  improved to meet at least minimum 
  5.55  management standards as determined by 
  5.56  the commissioner of natural resources.  
  5.57  Up to $50,000 of this appropriation is 
  5.58  for matching nongame program activities.
  5.59  (d) Acquisition and Development of 
  5.60  Scientific and Natural Areas 
  5.61  $369,000 the first year and $369,000 
  5.62  the second year are from the trust fund 
  5.63  to the commissioner of natural 
  5.64  resources to acquire and develop lands 
  5.65  with natural features of state 
  5.66  ecological or geological significance 
  5.67  in accordance with the scientific and 
  6.1   natural area program long-range plan.  
  6.2   Land acquired with this appropriation 
  6.3   must be sufficiently improved to meet 
  6.4   at least minimum management standards 
  6.5   as determined by the commissioner of 
  6.6   natural resources. 
  6.7   (e) Forest and Prairie Stewardship of 
  6.8   Public and Private Lands 
  6.9   $246,000 the first year and $246,000 
  6.10  the second year are from the trust fund 
  6.11  to the commissioner of natural 
  6.12  resources.  $197,000 of this 
  6.13  appropriation is to develop stewardship 
  6.14  plans for private forested lands and 
  6.15  implement stewardship plans on a 
  6.16  cost-share basis.  $295,000 of this 
  6.17  appropriation is to develop stewardship 
  6.18  plans on private prairie lands and 
  6.19  implement prairie management on public 
  6.20  and private lands.  This appropriation 
  6.21  is available until June 30, 2006, at 
  6.22  which time the project must be 
  6.23  completed and final products delivered, 
  6.24  unless an earlier date is specified in 
  6.25  the work program. 
  6.26  (f) Local Initiative 
  6.27  Grants-Conservation Partners and 
  6.28  Environmental Partnerships 
  6.29  $394,000 the first year and $394,000 
  6.30  the second year are from the trust fund 
  6.31  to the commissioner of natural 
  6.32  resources for matching grants of up to 
  6.33  $20,000 to local government and private 
  6.34  organizations for enhancement, 
  6.35  research, and education associated with 
  6.36  natural habitat and environmental 
  6.37  service projects.  This appropriation 
  6.38  is available until June 30, 2006, at 
  6.39  which time the project must be 
  6.40  completed and final products delivered, 
  6.41  unless an earlier date is specified in 
  6.42  the work program. 
  6.43  (g) Minnesota ReLeaf Community Forest 
  6.44  Development and Protection 
  6.45  $788,000 is from the future resources 
  6.46  fund to the commissioner of natural 
  6.47  resources for acceleration of the 
  6.48  agency program and a cooperative 
  6.49  agreement with Tree Trust to protect 
  6.50  forests resources, develop 
  6.51  inventory-based management plans, and 
  6.52  provide matching grants to communities 
  6.53  to plant native trees.  At least 
  6.54  $554,000 of this appropriation must be 
  6.55  used for grants to communities.  For 
  6.56  the purposes of this paragraph, the 
  6.57  match must be a nonstate contribution, 
  6.58  but may be either cash or qualifying 
  6.59  in-kind.  This appropriation is 
  6.60  available until June 30, 2006, at which 
  6.61  time the project must be completed and 
  6.62  final projects delivered, unless an 
  6.63  earlier date is specified in the work 
  6.64  program. 
  7.1   (h) Minnesota Ports Greening Initiative 
  7.2   $295,000 is from the future resources 
  7.3   fund to the commissioner of natural 
  7.4   resources for agreements with St. Paul 
  7.5   port authority and Winona port 
  7.6   authority to contract with Great River 
  7.7   Greening to establish native plantings 
  7.8   in the Mississippi river corridor at 
  7.9   the commercial port in St. Paul and to 
  7.10  develop a restoration plan in Winona. 
  7.11  (i) Developing Pheromones for Use in 
  7.12  Carp Control 
  7.13  $50,000 the first year and $50,000 the 
  7.14  second year are from the trust fund to 
  7.15  the University of Minnesota for 
  7.16  research on new options for controlling 
  7.17  carp.  This appropriation is available 
  7.18  until June 30, 2006, at which time the 
  7.19  project must be completed and final 
  7.20  products delivered, unless an earlier 
  7.21  date is specified in the work program. 
  7.22  (j) Biological Control of European 
  7.23  Buckthorn and Spotted Knapweed 
  7.24  $99,000 the first year and $99,000 the 
  7.25  second year are from the trust fund.  
  7.26  Of this amount, $54,000 the first year 
  7.27  and $55,000 the second year are to the 
  7.28  commissioner of natural resources for 
  7.29  research to evaluate potential insects 
  7.30  for biological control of invasive 
  7.31  European buckthorn species.  $45,000 
  7.32  the first year and $44,000 the second 
  7.33  year are to the commissioner of 
  7.34  agriculture to assess the effectiveness 
  7.35  of spotted knapweed biological control 
  7.36  agents.  This appropriation is 
  7.37  available until June 30, 2006, at which 
  7.38  time the project must be completed and 
  7.39  final products delivered, unless an 
  7.40  earlier date is specified in the work 
  7.41  program. 
  7.42  (k) Resources for Redevelopment of 
  7.43  Brownfields to Greenspaces 
  7.44  $198,000 is from the future resources 
  7.45  fund to the commissioner of natural 
  7.46  resources for an agreement with 
  7.47  Minnesota Environmental Initiatives to 
  7.48  identify and assess redevelopment of 
  7.49  brownfields for recreation, habitat, 
  7.50  and natural resource reuse.

  8.7   state park and recreation areas.  Land 
  8.8   acquired with this appropriation must 
  8.9   be sufficiently improved to meet at 
  8.10  least minimum management standards as 
  8.11  determined by the commissioner of 
  8.12  natural resources.  This appropriation 
  8.13  is available until June 30, 2006, at 
  8.14  which time the project must be 
  8.15  completed and final products delivered, 
  8.16  unless an earlier date is specified in 
  8.17  the work program. 
  8.18  (b) LAWCON Federal Reimbursements 
  8.19  $2,500,000 is from the future resources 
  8.20  fund to the commissioner of natural 
  8.21  resources for eligible state projects 
  8.22  and administrative and planning 
  8.23  activities consistent with Minnesota 
  8.24  Statutes, section 116P.14, and the 
  8.25  federal Land and Water Conservation 
  8.26  Fund Act.  This appropriation is 
  8.27  contingent upon receipt of the federal 
  8.28  obligation and remains available until 
  8.29  June 30, 2006, at which time the 
  8.30  project must be completed and final 
  8.31  products delivered, unless an earlier 
  8.32  date is specified in the work program. 
  8.33  (c) Local Initiative Grants-Parks and 
  8.34  Natural Areas 
  8.35  $1,720,000 the first year and 
  8.36  $1,720,000 the second year are from the 
  8.37  trust fund to the commissioner of 
  8.38  natural resources for matching grants 
  8.39  to local governments for acquisition 
  8.40  and development of natural and scenic 
  8.41  areas and local parks as provided in 
  8.42  Minnesota Statutes, section 85.019, 
  8.43  subdivisions 2 and 4a, and regional 
  8.44  parks outside of the metropolitan 
  8.45  area.  Grants may provide up to 50 
  8.46  percent of the nonfederal share of the 
  8.47  project cost, except nonmetropolitan 
  8.48  regional park grants may provide up to 
  8.49  60 percent of the nonfederal share of 
  8.50  the project cost.  The commission will 
  8.51  monitor the grants for approximate 
  8.52  balance over extended periods of time 
  8.53  between the metropolitan area, under 
  8.54  Minnesota Statutes, section 473.121, 
  8.55  subdivision 2, and the nonmetropolitan 
  8.56  area through work program oversight and 
  8.57  periodic allocation decisions.  For the 
  8.58  purposes of this paragraph, the match 
  8.59  must be a nonstate contribution, but 
  8.60  may be either cash or qualifying 
  8.61  in-kind. Recipients may receive funding 
  8.62  for more than one project in any given 
  8.63  grant period.  This appropriation is 
  8.64  available until June 30, 2006, at which 
  8.65  time the project must be completed and 
  8.66  final products delivered. 
  9.1   (d) Metropolitan Regional Parks 
  9.2   Acquisition, Rehabilitation, and 
  9.3   Development 
  9.4   $2,640,000 the first year and 
  9.5   $2,640,000 the second year are from the 
  9.6   trust fund to the commissioner of 
  9.7   natural resources for an agreement with 
  9.8   the metropolitan council for subgrants 
  9.9   for the acquisition, development, and 
  9.10  rehabilitation in the metropolitan 
  9.11  regional park system, consistent with 
  9.12  the metropolitan council regional 
  9.13  recreation open space capital 
  9.14  improvement plan.  This appropriation 
  9.15  may not be used for the purchase of 
  9.16  residential structures.  This 
  9.17  appropriation may be used to reimburse 
  9.18  implementing agencies for acquisition 
  9.19  of nonresidential property as expressly 
  9.20  approved in the work program.  This 
  9.21  appropriation is available until June 
  9.22  30, 2006, at which time the project 
  9.23  must be completed and final products 
  9.24  delivered, unless an earlier date is 
  9.25  specified in the work program.  In 
  9.26  addition, if a project financed under 
  9.27  this program receives a federal grant, 
  9.28  the availability of the financing from 
  9.29  this paragraph for that project is 
  9.30  extended to equal the period of the 
  9.31  federal grant. 
  9.32  (e) Local and Regional Trail Grant 
  9.33  Initiative Program 
  9.34  $246,000 the first year and $246,000 
  9.35  the second year are from the trust fund 
  9.36  to the commissioner of natural 
  9.37  resources to provide matching grants to 
  9.38  local units of government for the cost 
  9.39  of acquisition, development, 
  9.40  engineering services, and enhancement 
  9.41  of existing and new trail facilities.  
  9.42  This appropriation is available until 
  9.43  June 30, 2006, at which time the 
  9.44  project must be completed and final 
  9.45  products delivered, unless an earlier 
  9.46  date is specified in the work program.  
  9.47  In addition, if a project financed 
  9.48  under this program receives a federal 
  9.49  grant, the availability of the 
  9.50  financing from this paragraph for that 
  9.51  project is extended to equal the period 
  9.52  of the federal grant.  
  9.53  (f) Gitchi-Gami State Trail 
  9.54  $713,000 the first year and $713,000 
  9.55  the second year are from the trust fund 
  9.56  to the commissioner of natural 
  9.57  resources, in cooperation with the 
  9.58  Gitchi-Gami Trail Association, for the 
  9.59  third biennium, to design and construct 
  9.60  approximately five miles of Gitchi-Gami 
  9.61  state trail segments.  This 
  9.62  appropriation must be matched by at 
  9.63  least $400,000 of nonstate money.  The 
  9.64  availability of the financing from this 
  9.65  paragraph is extended to equal the 
  9.66  period of any federal money received. 
 10.1   (g) Water Recreation:  Boat Access, 
 10.2   Fishing Piers, and Shore-fishing 
 10.3   $885,000 the first year and $885,000 
 10.4   the second year are from the trust fund 
 10.5   to the commissioner of natural 
 10.6   resources to acquire and develop public 
 10.7   water access sites statewide, construct 
 10.8   shore-fishing and pier sites, and 
 10.9   restore shorelands at public accesses.  
 10.10  This appropriation is available until 
 10.11  June 30, 2006, at which time the 
 10.12  project must be completed and final 
 10.13  products delivered, unless an earlier 
 10.14  date is specified in the work program. 
 10.15  (h) Mesabi Trail 
 10.16  $344,000 the first year and $344,000 
 10.17  the second year are from the trust fund 
 10.18  to the commissioner of natural 
 10.19  resources for an agreement with St. 
 10.20  Louis and Lake Counties Regional Rail 
 10.21  Authority for the sixth biennium to 
 10.22  acquire and develop segments of the 
 10.23  Mesabi trail.  If a federal grant is 
 10.24  received, the availability of the 
 10.25  financing from this paragraph is 
 10.26  extended to equal the period of the 
 10.27  federal grant. 
 10.28  (i) Linking Communities Design, 
 10.29  Technology, and DNR Trail Resources 
 10.30  $246,000 is from the future resources

 16.35  investments must conform to the 
 16.36  enterprise information architecture

 16.38  Spatial data must conform to geographic 
 16.39  information system guidelines and 
 16.40  standards outlined in that architecture 
 16.41  and adopted by the Minnesota geographic 
 16.42  data clearinghouse at the land 
 16.43  management information center.  A 
 16.44  description of these data must be made

 17.3   Subd. 14.  Project Requirements 
 17.4   It is a condition of acceptance of the 
 17.5   appropriations in this section that any

 17.7   appropriation must comply with 
 17.8   Minnesota Statutes, chapter 116P, and 
 17.9   vegetation planted must be native to 
 17.10  Minnesota and preferably of the local 
 17.11  ecotype unless the work program

 17.13  allows the planting of species that are

 17.15  Subd. 15.  Match Requirements 
 17.16  Unless specifically authorized, 
 17.17  appropriations in this section that 
 17.18  must be matched and for which the match

 17.20  2003, are canceled, and in-kind 
 17.21  contributions may not be counted as 
 17.22  matching funds. 
 17.23  Subd. 16.  Payment Conditions and 
 17.24  Capital Equipment Expenditures 
 17.25  All agreements, grants, or contracts 
 17.26  referred to in this section must be 
 17.27  administered on a reimbursement basis.  
 17.28  Notwithstanding Minnesota Statutes, 
 17.29  section 16A.41, expenditures made on or 
 17.30  after July 1, 2003, or the date the 
 17.31  work program is approved, whichever is 
 17.32  later, are eligible for reimbursement 
 17.33  unless otherwise provided in this 
 17.34  section.  Payment must be made upon 
 17.35  receiving documentation that 
 17.36  project-eligible reimbursable amounts

 17.45  Subd. 17.  Purchase of Recycled and 
 17.46  Recyclable Materials 
 17.47  A political subdivision, public or 
 17.48  private corporation, or other entity 
 17.49  that receives an appropriation in this 
 17.50  section must use the appropriation in 
 17.51  compliance with Minnesota Statutes, 
 17.52  sections 16B.121 and 16B.122, requiring 
 17.53  the purchase of recycled, repairable, 
 17.54  and durable materials; the purchase of 
 17.55  uncoated paper stock; and the use of 
 17.56  soy-based ink, the same as if it were a 
 17.57  state agency.  
 17.58  Subd. 18.  Energy Conservation 
 17.59  A recipient to whom an appropriation is 
 17.60  made in this section for a capital 
 17.61  improvement project shall ensure that 
 18.1   the project complies with the 
 18.2   applicable energy conservation 
 18.3   standards contained in law, including 
 18.4   Minnesota Statutes, sections 216C.19 
 18.5   and 216C.20, and rules adopted 
 18.6   thereunder.  The recipient may use the 
 18.7   energy planning, advocacy, and state 
 18.8   energy office units of the department 
 18.9   of commerce to obtain information and 
 18.10  technical assistance on energy 
 18.11  conservation and alternative energy 
 18.12  development relating to the planning 
 18.13  and construction of the capital 
 18.14  improvement project.

 18.47  (a), hydraulic impacts of quarries and 
 18.48  gravel pits. 
 18.49     Sec. 2.  Minnesota Statutes 2002, section 116P.09, 
 18.50  subdivision 5, is amended to read: 
 18.51     Subd. 5.  [ADMINISTRATIVE EXPENSE.] The administrative 
 18.52  expenses of the commission shall be paid from the various funds 
 18.53  administered by the commission as follows: 
 18.54     (1) Through June 30, 1993, the administrative expenses of 
 18.55  the commission and the advisory committee shall be paid from the 
 18.56  Minnesota future resources fund.  After that time, the prorated 
 18.57  expenses related to administration of the trust fund shall be 
 19.1   paid from the earnings of the trust fund. 
 19.2      (2) After June 30, 1993, the prorated expenses related to 
 19.3   commission administration of the trust fund may not exceed an 
 19.4   amount equal to four percent of the projected earnings amount 
 19.5   available for appropriation of the trust fund for the biennium. 
 19.6      Sec. 3.  Minnesota Statutes 2002, section 116P.13, 
 19.7   subdivision 1, is amended to read: 
 19.8      Subdivision 1.  [REVENUE SOURCES.] The money in the 
 19.9   Minnesota future resources fund consists of revenue deposited in 
 19.10  the state land and water conservation account under section 
 19.11  116P.14, subdivision 2, and revenue credited under section 
 19.12  297F.10, subdivision 1, paragraph (b), clause (1). 
 19.13     Sec. 4.  Minnesota Statutes 2002, section 116P.14, 
 19.14  subdivision 1, is amended to read: 
 19.15     Subdivision 1.  [DESIGNATED AGENCY.] The department of 
 19.16  natural resources is designated as the state agency to apply 
 19.17  for, accept, receive, and disburse federal reimbursement funds 
 19.18  and private funds, which are granted to the state of Minnesota 
 19.19  from Section 6 of the federal Land and Water Conservation Fund 
 19.20  Act.
