  1.1                          A bill for an act 
  1.2             relating to health; adding coverage for laser eye 
  1.3             surgery to certain health plans; proposing coding for 
  1.4             new law in Minnesota Statutes, chapter 62A. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [62A.281] [COVERAGE FOR LASER EYE SURGERY.] 
  1.7      Subdivision 1.  [SCOPE OF COVERAGE.] This section applies 
  1.8   to all policies of accident and health insurance, health 
  1.9   maintenance contracts regulated under chapter 62D, health 
  1.10  benefit certificates offered through a fraternal benefit society 
  1.11  regulated under chapter 64B, and group subscriber contracts 
  1.12  offered by nonprofit health service plan corporations regulated 
  1.13  under chapter 62C.  This section does not apply to policies 
  1.14  designed primarily to provide coverage payable on a per diem, 
  1.15  fixed indemnity or nonexpense incurred basis, or policies that 
  1.16  provide only accident coverage. 
  1.17     Subd. 2.  [REQUIRED COVERAGE.] (a) Every policy, plan, 
  1.18  certificate, or contract referred to in subdivision 1 issued or 
  1.19  renewed after August 1, 1999, must provide coverage for laser 
  1.20  eye surgery for those individuals residing in Minnesota who meet 
  1.21  the definition of legally blind under Minnesota Rules, part 
  1.22  3325.0110, subpart 35. 
  1.23     (b) The vision problem of legal blindness must be 
  1.24  correctable with laser eye surgery.  The coverage required by 
  1.25  this section is limited to $1,500 per eye and is subject to a 
  2.1   policy's copayment requirement.
