  1.1                          A bill for an act 
  1.2             relating to natural resources; modifying conditions 
  1.3             for the commissioner of natural resources to remove 
  1.4             beaver dams; amending Minnesota Statutes 2000, section 
  1.5             97B.665, subdivision 1. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 97B.665, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [AGREEMENT BY COUNTY BOARD, LANDOWNER, AND 
  1.10  COMMISSIONER.] (a) When a drainage watercourse is impaired by a 
  1.11  beaver dam, the commissioner shall take action to remove the 
  1.12  impairment, if: 
  1.13     (1) the county board unanimously consents; 
  1.14     (2) the landowner approves; 
  1.15     (3) the commissioner agrees; and 
  1.16     (4) (3) the action is financially feasible. 
  1.17     (b) In a county with unanimous consent of the county board 
  1.18  of commissioners and approval of the landowner, the department 
  1.19  shall take action agreed to by unanimous consent of the county 
  1.20  board, and the commissioner, and the landowner.  The action may 
  1.21  include destruction or alteration of beaver dams and removal of 
  1.22  beaver.  
  1.23     (c) After notifying the landowner, the commissioner may 
  1.24  enter onto the property containing the beaver dam at reasonable 
  1.25  times for the purpose of destroying or altering the beaver dam 
  2.1   or removing beaver. 
  2.2      (d) This subdivision does not apply to state parks, state 
  2.3   game refuges, and federal game refuges.
