  1.1                          A bill for an act 
  1.2             relating to insurance; regulating activation of the 
  1.3             market assistance plan and the joint underwriting 
  1.4             association; amending Minnesota Statutes 2000, section 
  1.5             62I.21. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 62I.21, is 
  1.8   amended to read: 
  1.9      62I.21 [ACTIVATION OF MARKET ASSISTANCE PLAN AND JOINT 
  1.10  UNDERWRITING ASSOCIATION.] 
  1.11     Upon submission of an application for placement of general 
  1.12  liability insurance coverage under section 62I.13 in a class of 
  1.13  business for which the market assistance plan and the joint 
  1.14  underwriting association are not then activated, where the 
  1.15  applicant has been refused coverage within the meaning of 
  1.16  section 62I.13, subdivision 2, the commissioner may by notice in 
  1.17  the State Register activate the market assistance plan and the 
  1.18  joint underwriting association on Minnesota risks for the class 
  1.19  of business.  The plan and association are activated for a 
  1.20  period of 180 days from publication of the notice.  At the same 
  1.21  time the notice is published, the commissioner shall prepare a 
  1.22  written petition requesting that a hearing be held to determine 
  1.23  whether activation of the market assistance plan and the joint 
  1.24  underwriting association is necessary beyond the 180-day 
  1.25  period.  The hearing must be held in accordance with section 
  2.1   62I.22.  The commissioner by order shall deactivate a market 
  2.2   assistance program and the joint underwriting association at any 
  2.3   time the commissioner finds that the market assistance program 
  2.4   and the joint underwriting association are not necessary. 
  2.5      Sec. 2.  [EFFECTIVE DATE.] 
  2.6      Section 1 is effective retroactive to January 1, 2001.
