  1.1                          A bill for an act 
  1.2             relating to higher education; delaying implementation 
  1.3             of the higher education system merger; amending Laws 
  1.4             1991, chapter 356, article 9, section 9, as amended. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Laws 1991, chapter 356, article 9, section 9, 
  1.7   as amended by Laws 1994, chapter 532, article 5, section 1, is 
  1.8   amended to read: 
  1.9      Sec. 9.  [TRANSFER PROVISIONS.] 
  1.10     Subdivision 1.  [TRANSFER OF POWERS; GENERALLY.] The state 
  1.11  board of technical colleges, the state board for community 
  1.12  colleges, and the state university board and their respective 
  1.13  chancellors retain responsibility for operating and managing 
  1.14  their systems until July 1, 1995.  On July 1, 1995, the 
  1.15  authority, duties, responsibilities, related property of the 
  1.16  state board of technical colleges, school boards, intermediate 
  1.17  school boards, and joint vocational technical boards with 
  1.18  respect to technical colleges, the state board for community 
  1.19  colleges, and the state university board are transferred to the 
  1.20  higher education board under Minnesota Statutes, section 15.039. 
  1.21     Effective July 1, 1995, school boards, intermediate school 
  1.22  boards, and joint vocational technical boards shall transfer to 
  1.23  the higher education board all real property, personal property, 
  1.24  and improvements and attachments thereto related to technical 
  1.25  colleges as determined by the higher education board, and shall 
  2.1   convey all interests in the property.  The school boards, 
  2.2   intermediate school boards, and joint vocational technical 
  2.3   boards shall not receive compensation for the conveyance of the 
  2.4   interests.  All debt service payments on the transferred 
  2.5   property that have a due date on or after July 1, 1995, become 
  2.6   the responsibility of the higher education board. 
  2.7      On July 1, 1995, all other obligations incurred on behalf 
  2.8   of a technical college by a school board, a joint vocational 
  2.9   district under Minnesota Statutes, section 136C.60, or an 
  2.10  intermediate school district under Minnesota Statutes, chapter 
  2.11  136D, which will not be satisfied on or before June 30, 1995, 
  2.12  transfer to the higher education board subject to limits 
  2.13  identified in state law or in plans or policies of the higher 
  2.14  education board subject to legislative approval. 
  2.15     The state board of technical colleges, state board for 
  2.16  community colleges, and state university board are abolished, 
  2.17  effective July 1, 1995.  
  2.18     Notwithstanding anything in this section, the state board 
  2.19  of technical colleges, the state university board, and the state 
  2.20  board for community colleges shall retain responsibility for 
  2.21  operating and managing their respective systems until the 
  2.22  anticipated costs of the transfer of system authority, duties, 
  2.23  responsibilities, and related property to the higher education 
  2.24  board, other than merely incidental costs, for the biennium 
  2.25  beginning July 1, 1995, are identified in law, and the 
  2.26  legislature appropriates money in the amount identified to the 
  2.27  higher education board, which amount shall be in addition to the 
  2.28  appropriation allocated to the higher education board under Laws 
  2.29  1993, First Special Session chapter 2, article 1, section 9, 
  2.30  subdivision 8. 
  2.31     Sec. 2.  [EFFECTIVE DATE.] 
  2.32     Section 1 is effective the day following final enactment.
