  1.1                          A bill for an act 
  1.2             relating to crime prevention; requiring the 
  1.3             commissioner of corrections to submit an analysis 
  1.4             addressing correctional capacity. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [PLAN TO INCREASE STATE CORRECTIONAL CAPACITY.] 
  1.7      (a) The commissioner of corrections shall submit an 
  1.8   analysis to the legislature on ways to incarcerate inmates 
  1.9   projected to be committed to the commissioner's custody when the 
  1.10  number of those inmates are in excess of the department's 
  1.11  current capacity. 
  1.12     (b) The analysis must address the feasibility and 
  1.13  advisability of expanding current correctional facilities to 
  1.14  meet the need for expanded capacity and include a plan to do so. 
  1.15     (c) In addition, the analysis must address the advisability 
  1.16  of constructing new correctional facilities as a means of 
  1.17  meeting the department's capacity needs.  If the commissioner 
  1.18  determines that it is advisable to construct a new correctional 
  1.19  facility, the commissioner shall convene the correctional 
  1.20  facility site selection committee established under Minnesota 
  1.21  Statutes, section 243.93, to make recommendations on the siting 
  1.22  of this new facility and include these recommendations and a 
  1.23  plan for constructing the facility in the analysis. 
  1.24     (d) By January 15, 2004, the commissioner shall submit the 
  1.25  analysis required under this section to the chairs and ranking 
  2.1   minority members of the senate and house of representatives 
  2.2   committees and divisions having jurisdiction over correctional 
  2.3   policy and funding.  
  2.4      Sec. 2.  [EFFECTIVE DATE.] 
  2.5      Section 1 is effective the day following final enactment.
