  1.1                          A bill for an act 
  1.2             relating to health; permitting sale of health 
  1.3             promotion and education material; appropriating money; 
  1.4             amending Minnesota Statutes 1996, section 144.394. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1996, section 144.394, is 
  1.7   amended to read: 
  1.8      144.394 [SMOKING PREVENTION HEALTH PROMOTION AND 
  1.9   EDUCATION.] 
  1.10     The commissioner may sell at market value, all nonsmoking 
  1.11  or tobacco use prevention advertising health promotion and 
  1.12  health education materials.  Proceeds from the sale of the 
  1.13  advertising materials are appropriated to the department of 
  1.14  health for its nonsmoking the program that developed the 
  1.15  material.
