  1.1                          A bill for an act 
  1.2             relating to education; appropriating money for school 
  1.3             district energy costs. 
  1.4   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.5      Section 1.  [EMERGENCY ENERGY ASSISTANCE.] 
  1.6      Subdivision 1.  [COMMISSIONER.] By February 28, 2001, the 
  1.7   commissioner of children, families, and learning shall certify 
  1.8   the heating fuel costs for school facilities and the fuel costs 
  1.9   for transporting students for each school district for the 
  1.10  1999-2000 school year. 
  1.11     Subd. 2.  [SCHOOL DISTRICT.] By February 28, 2001, each 
  1.12  school district shall submit its anticipated heating fuel costs 
  1.13  for school facilities and its anticipated fuel costs for 
  1.14  transporting students for the 2000-2001 school year to the 
  1.15  commissioner. 
  1.16     Subd. 3.  [ENERGY COST.] The commissioner shall calculate 
  1.17  the difference between the 2000-2001 anticipated heating fuel 
  1.18  and transportation fuel costs under subdivision 2, and the 
  1.19  certified 1999-2000 heating fuel and transportation fuel costs 
  1.20  under subdivision 1. 
  1.21     Subd. 4.  [REIMBURSEMENT.] The commissioner shall reimburse 
  1.22  school districts for 97 percent of the amount calculated under 
  1.23  subdivision 3 not to exceed a statewide total of $30,000,000.  
  1.24  If the appropriation is insufficient, the commissioner shall 
  2.1   proportionately reduce the reimbursement. 
  2.2      Subd. 5.  [CHARTER SCHOOL.] For the purposes of this 
  2.3   section, a charter school is a school district. 
  2.4      Subd. 6.  [PAYMENT ADJUSTMENT.] By January 31, 2002, the 
  2.5   department of children, families, and learning shall certify the 
  2.6   actual heating fuel costs for school facilities and the fuel 
  2.7   costs for transporting students for each school district for the 
  2.8   2000-2001 school year and recalculate the school district 
  2.9   reimbursement amount, under subdivision 4, based on actual 
  2.10  costs.  The department of children, families, and learning, 
  2.11  shall adjust general education aid paid to school districts for 
  2.12  fiscal year 2002 by the amount of the difference between the 
  2.13  estimated calculation and the actual costs. 
  2.14     [EFFECTIVE DATE.] This section is effective the day 
  2.15  following final enactment. 
  2.16     Sec. 2.  [APPROPRIATION.] 
  2.17     $30,000,000 is appropriated in fiscal year 2001 from the 
  2.18  general fund to the commissioner of children, families, and 
  2.19  learning for emergency energy assistance under section 1.  This 
  2.20  appropriation is available until June 30, 2002.  Of this amount, 
  2.21  the department may retain up to $30,000 for the administration 
  2.22  of this program.  
  2.23     [EFFECTIVE DATE.] This section is effective the day 
  2.24  following final enactment.
