A bill for an act
relating to cosmetology; providing for cosmetology apprenticeships; amending
Minnesota Statutes 2014, sections 155A.23, by adding a subdivision; 155A.27,
subdivisions 1, 2; proposing coding for new law in Minnesota Statutes, chapter
155A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2014, section 155A.23, is amended by adding a
subdivision to read:

new text begin "Apprentice" means a person registered with the board who
is learning the practice of cosmetology under section 155A.272 in a licensed salon, and
practices or assists with the practice of cosmetology as provided under subdivision 3.

Sec. 2.

Minnesota Statutes 2014, section 155A.27, subdivision 1, is amended to read:


Subdivision 1.

Licensing.

Individual licensing shall be required for persons seeking
to practice in the state as a cosmetologist, esthetician, nail technician, manager, or
instructornew text begin , unless the person is an apprentice under section 155A.272new text end .

Sec. 3.

Minnesota Statutes 2014, section 155A.27, subdivision 2, is amended to read:


Subd. 2.

Qualifications.

Qualifications for licensing in each classification shall
be determined by the board and established by rule, and shall include educational and
experiential prerequisites. The rules shall require a demonstrated knowledge of procedures
necessary to protect the health of the practitioner and the consumer of cosmetology
services, including but not limited to chemical applications.new text begin Individuals who successfully
complete an apprenticeship program under section 155A.272 are deemed to have
completed the educational and experiential prerequisites for licensure.

new text begin All apprentices shall be employed under an apprentice
agreement between the sponsoring salon and the apprentice and approved by the
Department of Labor and Industry under section 178.07. All apprenticeships are governed
by the requirements of chapter 178, the minimum standards of apprenticeship under
Minnesota Rules, part 5200.0320, and the requirements of this chapter and any rules
adopted by the board.

new text begin Apprentices shall receive from a licensed salon
at least 3,180 hours of practical training and at least 288 training hours of theoretical
instruction in order to complete the apprenticeship program and be eligible to take the
examination for a cosmetologist license. Apprentices shall receive training for a total of at
least 32 hours per week. The training shall be completed in not less than two years and
not more than four years.

new text begin (a) No apprentice under this section may practice cosmetology
except under the supervision of a licensed cosmetology manager, whose cosmetology
license is not an inactive license, or under the supervision of a licensed cosmetologist,
whose cosmetologist license is not an inactive license, and to whom supervisory authority
has been delegated by a licensed cosmetology manager. A licensed cosmetology manager
may only delegate supervisory authority to a licensed cosmetologist who has completed
at least 2,000 hours of practice as a licensed cosmetologist. A supervising cosmetology
manager must have had a valid license for a minimum of three consecutive years. A
supervising cosmetology instructor must have had a valid license for a minimum of one
year.

required to be taught in schools of cosmetology as prescribed by the examining board by
rule.
