  1.1                          A bill for an act 
  1.2             relating to health; waiving immediate jeopardy fines 
  1.3             imposed by the department of health. 
  1.4   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.5      Section 1.  [IMMEDIATE JEOPARDY FINES.] 
  1.6      (a) All nursing fines levied for immediate jeopardy 
  1.7   citations by the Minnesota health department from April 1, 1998, 
  1.8   through January 13, 1999, shall be paid to the Health Care 
  1.9   Financing Administration (HCFA) by the health department using 
  1.10  the department's current budget resources.  
  1.11     (b) The following nursing homes shall be reimbursed by the 
  1.12  health department for immediate jeopardy fines paid by the 
  1.13  facility:  Maplewood Care Center in Maplewood, MN for $27,000; 
  1.14  and Burr Oak Manor in Austin, MN for $70,525. 
  1.15     (c) The following nursing homes' immediate jeopardy fines 
  1.16  levied by the department of health are waived:  Pelican Lake in 
  1.17  Ashby, MN for $145,000 ($5,000 per day times 29 days); Fairview 
  1.18  Nursing Home in Rochester, MN for $21,550; Samaritan Bethany on 
  1.19  8th in Rochester, MN for $43,350; Shakopee Friendship Village in 
  1.20  Shakopee, MN for $22,250; Maplewood Care Center in Maplewood, MN 
  1.21  for $13,000; Stillwater Good Samaritan in Stillwater, MN for 
  1.22  $16,000; Nopeming Nursing Home in Nopeming, MN for $16,000 plus 
  1.23  the amount undetermined of $350 until compliance; Burr Oak Manor 
  1.24  in Austin, MN for $24,683; Madison Lutheran Home in Madison, MN 
  2.1   for $21,000; Grandview Christian Home in Cambridge, MN for 
  2.2   $84,650; Colonial Manor in Balatin, MN for $16,600; the Lutheran 
  2.3   Home in Caledonia, MN for $125,000 ($5,000 per day times 25 
  2.4   days); Walker Methodist Health Care in Minneapolis, MN for 
  2.5   $39,000; Arnold Memorial Health Care in Adrian, MN for $26,650; 
  2.6   Viking Manor in Ulen, MN for an undetermined amount; Trevilla of 
  2.7   Golden Valley in Golden Valley, MN for an undetermined amount; 
  2.8   St. Francis Home in Breckenridge, MN for $11,450; Whittier 
  2.9   Health Care in Minneapolis, MN for $8,000 and $350 until 
  2.10  compliance; and Stewartville Care Center in Stewartville, MN for 
  2.11  $17,000. 
  2.12     (d) Those nursing facilities not covered in paragraphs (b) 
  2.13  and (c) who have paid immediate jeopardy fines from April 1, 
  2.14  1998, through January 13, 1999, shall have those fines 
  2.15  reimbursed by the department of health and those fines not yet 
  2.16  paid by facilities are waived. 
  2.17     Sec. 2.  [EFFECTIVE DATE.] 
  2.18     Section 1 is effective the day following final enactment.
