  1.1                          A bill for an act 
  1.2             relating to corrections; expanding eligibility for the 
  1.3             work release program to allow inmates to continue 
  1.4             caring for their children who have special needs; 
  1.5             amending Minnesota Statutes 1994, section 631.425, 
  1.6             subdivisions 1 and 3. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1994, section 631.425, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [DEFINITIONS.] (a) The definitions in this 
  1.11  subdivision apply to this section.  
  1.12     (b) "Court" means a court having criminal jurisdiction.  
  1.13     (c) "Sheriff" includes a chief of police and workhouse 
  1.14  superintendent.  
  1.15     (d) "Jail" includes a county jail, workhouse, and lockup.  
  1.16     (e) "Employment" means working at a paying job or caring 
  1.17  for a child with special needs. 
  1.18     Sec. 2.  Minnesota Statutes 1994, section 631.425, 
  1.19  subdivision 3, is amended to read: 
  1.20     Subd. 3.  [CONTINUATION OF EMPLOYMENT; CARE OF CHILDREN 
  1.21  WITH SPECIAL NEEDS.] (a) If the person committed under this 
  1.22  section has been regularly employed, the sheriff shall arrange 
  1.23  for a continuation of the employment insofar as possible without 
  1.24  interruption.  If the person is not employed, the court may 
  1.25  designate a suitable person or agency to make reasonable efforts 
  1.26  to secure some suitable employment for that person.  An inmate 
  2.1   employed under this section paragraph must be paid a fair and 
  2.2   reasonable wage for work performed and must work at fair and 
  2.3   reasonable hours per day and per week.  
  2.4      (b) If the inmate had been regularly providing full-time 
  2.5   care for the inmate's child or children with special needs, the 
  2.6   sheriff shall arrange for the person to continue providing that 
  2.7   care for a specified period up to 12 hours per day.  The local 
  2.8   welfare agency shall determine whether the inmate's child has 
  2.9   special needs.
