  1.1                          A bill for an act 
  1.2             relating to crime prevention; altering occupancy 
  1.3             standards in adult correctional facilities; amending 
  1.4             Minnesota Statutes 1996, section 243.53. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1996, section 243.53, is 
  1.7   amended to read: 
  1.8      243.53 [SEPARATE CELLS; MULTIPLE OCCUPANCY STANDARDS.] 
  1.9      Subdivision 1.  [SEPARATE CELLS.] When there are cells 
  1.10  sufficient, each convict inmate shall be confined in a separate 
  1.11  cell.  Each inmate shall be confined in a separate cell 
  1.12  in close, maximum, and high security facilities custody level 5 
  1.13  and level 6 institutions, including the St. Cloud, Stillwater, 
  1.14  and Oak Park Heights facilities, but not including geriatric or 
  1.15  honor dormitory-type facilities housing. 
  1.16     Subd. 2.  [MULTIPLE OCCUPANCY STANDARDS.] A medium security 
  1.17  correctional facility that is built or remodeled after July 1, 
  1.18  1992, for the purpose of increasing inmate capacity must be 
  1.19  designed and built to Custody level 1 through level 4 
  1.20  institutions must comply with multiple occupancy standards 
  1.21  for not more than at least one-half of the facility's capacity.  
  1.22  Multiple occupancy standards must include double celling 
  1.23  and must include a maximum capacity figure.  A minimum security 
  1.24  correctional facility that is built or remodeled after July 1, 
  1.25  1992, must be designed and built to comply with minimum security 
  2.1   multiple occupancy standards.
