  1.1                          A bill for an act 
  1.2             relating to transportation; allocating revenues from 
  1.3             motor vehicle sales tax; proposing amendment to 
  1.4             Minnesota Constitution, article XIV, by adding a 
  1.5             section to require all of the proceeds from the sales 
  1.6             tax on motor vehicles be deposited in the highway user 
  1.7             tax distribution fund; amending Minnesota Statutes 
  1.8             2002, section 297B.09, subdivision 1. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2002, section 297B.09, 
  1.11  subdivision 1, is amended to read: 
  1.12     Subdivision 1.  [DEPOSIT OF REVENUES.] (a) Money collected 
  1.13  and received under this chapter must be deposited as provided in 
  1.14  this subdivision.  
  1.15     (b) From July 1, 2001, to June 30, 2002, 30.86 percent of 
  1.16  the money collected and received must be deposited in the 
  1.17  highway user tax distribution fund, and the remaining money must 
  1.18  be deposited in the general fund.  
  1.19     (c) On and after July 1, 2002, 32 percent of the money 
  1.20  collected and received must be deposited in the highway user tax 
  1.21  distribution fund, 20.5 percent must be deposited in the 
  1.22  metropolitan area transit fund under section 16A.88, and 1.25 
  1.23  percent must be deposited in the greater Minnesota transit fund 
  1.24  under section 16A.88.  In fiscal year 2004 and thereafter, two 
  1.25  percent of the money collected and received must be deposited in 
  1.26  the metropolitan area transit appropriation account under 
  1.27  section 16A.88.  The remaining money must be deposited in the 
  2.1   general fund. 
  2.2      Sec. 2.  [CONSTITUTIONAL AMENDMENT PROPOSED.] 
  2.3      An amendment to the Minnesota Constitution, article XIV, is 
  2.4   proposed to the people.  If adopted, the title of article XIV 
  2.5   will be "TRANSPORTATION" and the article will be amended by 
  2.6   adding a section to read: 
  2.7      Sec. 12.  The legislature shall appropriate in each fiscal 
  2.8   year from the general fund to the highway user tax distribution 
  2.9   fund an amount equal to all of the net proceeds from a sales tax 
  2.10  imposed by law on the purchase price of new and used motor 
  2.11  vehicles. 
  2.12     Sec. 3.  [SUBMISSION TO VOTERS.] 
  2.13     The proposed amendment must be submitted to the people at 
  2.14  the 2004 general election.  The question submitted must be: 
  2.15     "Shall the Minnesota Constitution be amended to require 
  2.16  that the legislature annually appropriate for highway purposes 
  2.17  all of the net proceeds from a sales tax on new and used motor 
  2.18  vehicles? 
  2.19                                     Yes .......
  2.20                                     No ........"
  2.21     Sec. 4.  [EFFECTIVE DATE.] 
  2.22     Section 1 is effective for money collected and received 
  2.23  after June 30, 2005.
