1.1 A bill for an act 1.2 relating to state lands; modifying certain boundary 1.3 waters canoe area provisions; providing for certain 1.4 state land acquisition; modifying the Mississippi 1.5 whitewater trail; modifying provisions of the outdoor 1.6 recreation system; establishing a mineral coordinating 1.7 committee; establishing boundaries for a proposed 1.8 state park; adding to and deleting from state parks, 1.9 state recreation areas, state forests, and wildlife 1.10 management areas; authorizing public and private sales 1.11 and conveyances of certain state lands; requiring 1.12 certain land exchanges; modifying certain 1.13 appropriations conditions; amending Minnesota Statutes 1.14 2002, sections 84.523, by adding a subdivision; 1.15 85.013, subdivision 1; 85.0156, subdivision 1; 86A.04; 1.16 Laws 2001, First Special Session chapter 2, section 1.17 14, subdivision 4; proposing coding for new law in 1.18 Minnesota Statutes, chapter 93. 1.19 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.20 Section 1. Minnesota Statutes 2002, section 84.523, is 1.21 amended by adding a subdivision to read: 1.22 Subd. 6. [STATE OWNED LANDS.] Acquired lands owned by the 1.23 state within the boundary waters canoe area defined in 1.24 subdivision 1 are designated as state wilderness areas under 1.25 section 86A.05, subdivision 6. 1.26 Sec. 2. Minnesota Statutes 2002, section 85.013, 1.27 subdivision 1, is amended to read: 1.28 Subdivision 1. [NAMES, ACQUISITION; ADMINISTRATION.]State1.29parks,(a) Designated monuments, recreation reserves, and 1.30 waysides heretofore established and hereby confirmed as state 1.31 monuments, state recreation areas and state waysides together 1.32 with the counties in which they are situated are listed in this 2.1 section and shall hereafter be named as indicated in this 2.2 section. 2.3 (b) Any land that now is or hereafter becomes tax-forfeited 2.4 land and is located within the described boundaries of a state 2.5 recreation area as defined by session laws is hereby withdrawn 2.6 from sale and is transferred from the custody, control, and 2.7 supervision of the county board of the county to the 2.8 commissioner of natural resources, free from any trust in favor 2.9 of the interested taxing districts. The commissioner shall 2.10 execute a certificate of acceptance of the lands on behalf of 2.11 the state for such purposes and transmit the same to the county 2.12 auditor of the county for record as provided by law in the case 2.13 of tax-forfeited land transferred to the commissioner by 2.14 resolution of the county board for conservation purposes. 2.15 Sec. 3. Minnesota Statutes 2002, section 85.0156, 2.16 subdivision 1, is amended to read: 2.17 Subdivision 1. [CREATION.] An urban whitewater trail is 2.18 created along the Mississippi river in thelowerSt. Anthony 2.19 falls areabelow the stone arch bridgein Minneapolis. The 2.20 trail must be primarily developed for whitewater rafters, 2.21 canoers, and kayakers. 2.22 Sec. 4. Minnesota Statutes 2002, section 86A.04, is 2.23 amended to read: 2.24 86A.04 [COMPOSITION OF SYSTEM.] 2.25 The outdoor recreation system shall consist of all state 2.26 parks; state recreation areas; state trails established pursuant 2.27 to sections 84.029, subdivision 2,and85.015, 85.0155, and 2.28 85.0156; state scientific and natural areas; state wilderness 2.29 areas; state forests; state wildlife management areas; state 2.30 water access sites, which include all lands and facilities 2.31 established by the commissioner of natural resources or the 2.32 commissioner of transportation to provide public access to 2.33 water; state wild, scenic, and recreational rivers; state 2.34 historic sites; state rest areas, which include all facilities 2.35 established by the commissioner of transportation for the 2.36 safety, rest, comfort and use of the highway traveler, and shall 3.1 include all existing facilities designated as rest areas and 3.2 waysides by the commissioner of transportation; and any other 3.3 units not listed in this section that are classified under 3.4 section 86A.05. Each individual state park, state recreation 3.5 area, and so forth is called a "unit." 3.6 Sec. 5. [93.0015] [MINERAL COORDINATING COMMITTEE.] 3.7 Subdivision 1. [ESTABLISHMENT; MEMBERSHIP.] The mineral 3.8 coordinating committee is established to plan for diversified 3.9 mineral development. The mineral coordinating committee 3.10 consists of: 3.11 (1) the commissioner of natural resources; 3.12 (2) the deputy commissioner of the Minnesota pollution 3.13 control agency; 3.14 (3) the director of United Steelworkers of America, 3.15 district 11, or the director's designee; 3.16 (4) the commissioner of iron range resources and 3.17 rehabilitation; 3.18 (5) the director of the Minnesota geological survey; 3.19 (6) the dean of the University of Minnesota institute of 3.20 technology; 3.21 (7) the director of the natural resources research 3.22 institute; and 3.23 (8) three individuals appointed by the governor for a 3.24 four-year term, one each representing the iron ore and taconite, 3.25 nonferrous metallic minerals, and industrial minerals industries 3.26 within the state. 3.27 Subd. 2. [STAFFING.] The commissioner of natural resources 3.28 shall serve as chair of the committee. A member of the 3.29 committee may designate another person of the member's 3.30 organization to act in the member's place. The commissioner 3.31 shall provide staff and administrative services necessary for 3.32 the committee's activities. 3.33 Subd. 3. [EXPIRATION.] Notwithstanding section 15.059, 3.34 subdivision 5, or other law to the contrary, the committee 3.35 expires June 30, 2007. 3.36 Subd. 4. [ADVICE.] The mineral coordinating committee is 4.1 encouraged to solicit and receive advice from representatives of 4.2 the United States Geological Survey, United States Environmental 4.3 Protection Agency, and United States Department of Energy. 4.4 Sec. 6. [PROPOSED GREENLEAF LAKE STATE PARK.] 4.5 Subdivision 1. [PROPOSED PARK.] Boundaries for a proposed 4.6 Greenleaf Lake state park in Meeker county are established 4.7 according to subdivision 2. 4.8 Subd. 2. The 6.2 commissioner may only purchase land for Greenleaf state park 6.3 with money appropriated specifically for that purpose. 6.4 Sec. 7. [ADDITIONS TO STATE PARKS.] 6.5 Subdivision 1. [85.012] [Subd. 18.] [FORT SNELLING STATE 6.6 PARK, RAMSEY, HENNEPIN, AND DAKOTA COUNTIES.] The following 6.7 areas are added to Ft. [DELETION FROM TETTEGOUCHE STATE PARK.] 10.10 [85.012] [Subd. 55a.] [TETTEGOUCHE STATE PARK, LAKE 10.11 COUNTY.] The following area is deleted from Tettegouche state 10.12 park, Lake county: the Southwest Quarter of Section 16, 10.13 Township 56 North, Range 7 West. 10.14 Sec. 9. [ADDITIONS TO STATE RECREATION AREAS.] 10.15 Subdivision 1. [85.013] [Subd. 2c.] [BIG BOG STATE 10.16 RECREATION AREA, BELTRAMI COUNTY.] The following area is added 10.17 to Big Bog state recreation area, Beltrami county: that part of 10.18 Government Lot 6 lying east of Minnesota state trunk highway 72, 10.19 Section 5, Township 154, Range 30. 10.20 Subd. 2. [85.013] [Subd. 12a.] [IRON RANGE OFF-HIGHWAY 10.21 VEHICLE RECREATION AREA, ST. LOUIS COUNTY.] The following areas 10.22 are added to Iron Range Off-Highway Vehicle recreation area, St. 10.23 Louis county: 10.24 (1) the NW1/4, lying north of the Mesabi Trail, in Section 10.25 23, Township 58 North, Range 17 West, containing approximately 10.26 80 acres; and 10.27 (2) the N1/2 of the NW1/4, SW1/4 of the NW1/4, and the 10.28 NW1/4 of the SW1/4 all in Section 3, Township 58 North, Range 17 10.29 West, containing approximately 160 acres. 10.30 Sec. 10. [ADDITIONS TO STATE FORESTS.] 10.31 Subdivision 1. This appropriation is 13.44 available until June 30, 2004, at which 13.45 time the project must be completed and 13.46 final products delivered, unless an 13.47 earlier date is specified in the work 13.48 program. 13.49 (e) Restoring Minnesota's 13.50 Fish and Wildlife Habitat 13.51 Corridors 13.52 $5,873,000 the first year and 13.53 $5,872,000 the second year are from the 13.54 trust fund to the commissioner of 13.55 natural resources for acceleration of 13.56 agency programs and cooperative 13.57 agreements with Minnesota Waterfowl 13.58 Association, Minnesota Deer Hunters 13.59 Association, Ducks Unlimited, Inc., 13.60 National Wild Turkey Federation, 13.61 Pheasants Forever, The Nature 13.62 Conservancy, Minnesota Land Trust, 13.63 Trust for Public Land, U.S. Fish and 14.1 Wildlife Service, Bureau of Indian 14.2 Affairs, Natural Resources Conservation 14.3 Service, and the U.S. Forest Service to 14.4 restore and acquire fragmented 14.5 landscape corridors that connect areas 14.6 of quality habitat to sustain fish, 14.7 wildlife, and plants. $352,000 is for 14.8 program coordination, corridor 14.9 identification, and mapping. 14.10 $3,343,000 is for restoration and 14.11 management activities in wildlife 14.12 management areas, wetland habitat, 14.13 lakes, wild rice beds, grasslands, and 14.14 fisheries habitat. $2,650,000 is for 14.15 conservation easement programs on 14.16 riparian areas, big woods forests, 14.17 native prairies, and wetlands. 14.18 $5,400,000 is for habitat acquisition 14.19 activities on prairies, riparian areas, 14.20 and other fish and wildlife habitat 14.21 corridors. As part of the required 14.22 work program, criteria and priorities 14.23 for planned acquisition and restoration 14.24 activities must be submitted to the 14.25 legislative commission on Minnesota 14.26 resources for review and approval. 14.27 Land acquired with this appropriation 14.28 must be sufficiently improved to meet 14.29 at least minimum management standards 14.30 as determined by the commissioner of 14.31 natural resources. Any land acquired 14.32 in fee title by the commissioner of 14.33 natural resources with money from this 14.34 appropriation must be designated: 14.35 (1) as an outdoor recreation unit under 14.36 Minnesota Statutes, section 86A.07; or 14.37 (2) as provided in Minnesota Statutes, 14.38 sections 89.018, subdivision 2, 14.39 paragraph (a); 97A.101; 97A.125; 14.40 97C.001; and 97C.011. 14.41 The commissioner may so designate any 14.42 lands acquired in less than fee title. 14.43 This appropriation is available until 14.44 June 30, 2004, at which time the 14.45 project must be completed and final 14.46 products delivered, unless an earlier 14.47 date is specified in the work program. 14.48 (f) Engineering Support for 14.49 Public Lands Waterfowl 14.50 Projects 14.51 $275,000 is from the future resources 14.52 fund to the commissioner of natural 14.53 resources for an agreement with Ducks 14.54 Unlimited, Inc., to provide survey and 14.55 engineering support to natural 14.56 resources agencies for waterfowl 14.57 projects on public lands. 14.58 (g) Metro Greenways 14.59 $1,365,000 the first year and 14.60 $1,365,000 the second year are from the 14.61 trust fund to the commissioner of 14.62 natural resources for the metro 14.63 greenways program for planning, 14.64 improving, and protecting important 15.1 natural areas in the metropolitan 15.2 region through grants, contracted 15.3 services, conservation easements, and 15.4 fee acquisition. Land acquired with 15.5 this appropriation must be sufficiently 15.6 improved to meet at least minimum 15.7 management standards as determined by 15.8 the commissioner of natural resources. 15.9 This appropriation is available until 15.10 June 30, 2004, at which time the 15.11 project must be completed and final 15.12 products delivered, unless an earlier 15.13 date is specified in the work program. 15.14 (h) Acquisition of Lands as 15.15 Scientific and Natural Areas 15.16 $227,000 the first year and $228,000 15.17 the second year are from the trust fund 15.18 to the commissioner of natural 15.19 resources to acquire land with natural 15.20 features of statewide significance in 15.21 the scientific and natural area program 15.22 long-range plan and to improve land 15.23 acquired with this appropriation. Land 15.24 acquired with this appropriation must 15.25 be sufficiently improved to meet at 15.26 least minimum management standards as 15.27 determined by the commissioner of 15.28 natural resources. 15.29 (i) Big Rivers Partnership: 15.30 Helping Communities to Restore 15.31 Habitat 15.32 $455,000 the first year and $455,000 15.33 the second year are from the trust fund 15.34 to the commissioner of natural 15.35 resources for an agreement with Great 15.36 River Greening to implement private and 15.37 public habitat projects on a cost-share 15.38 basis in the Mississippi and Minnesota 15.39 river valleys. This appropriation is 15.40 available until June 30, 2004, at which 15.41 time the project must be completed and 15.42 final products delivered, unless an 15.43 earlier date is specified in the work 15.44 program. 15.45 (j) Acquisition of 15.46 Eagle Creek's Last Private Land 15.47 $910,000 is from the future resources 15.48 fund to the commissioner of natural 15.49 resources for an agreement with the 15.50 city of Savage to acquire a buffer 15.51 strip along Eagle Creek for transfer 15.52 and dedication as an aquatic management 15.53 area. Acquisition expenses incurred 15.54 prior to July 1, 2001, may be 15.55 reimbursed by the commissioner. Land 15.56 acquired with this appropriation must 15.57 be sufficiently improved to meet at 15.58 least minimum management standards as 15.59 determined by the commissioner of 15.60 natural resources. 15.61 (k) Neighborhood Wilds 15.62 Program 15.63 $135,000 is from the future resources 16.1 fund to the commissioner of natural 16.2 resources for the neighborhood wilds 16.3 program to assist neighborhoods 16.4 adjacent to public lands and natural 16.5 areas in restoration and management of 16.6 habitat through demonstration 16.7 projects. This appropriation is 16.8 available until June 30, 2004, at which 16.9 time the project must be completed and 16.10 final products delivered, unless an 16.11 earlier date is specified in the work 16.12 program. 16.13 Sec. 14. [PRIVATE SALE OF CONSOLIDATED CONSERVATION LAND; 18.4 BELTRAMI COUNTY.] 18.5 (a) Notwithstanding the classification and public sale 18.6 provisions of Minnesota Statutes, chapters 84A and 282, the 18.7 commissioner of natural resources may sell to Waskish township 18.8 the consolidated conservation land that is described in 18.9 paragraph (c) under the remaining provisions of Minnesota 18.10 Statutes, chapters 84A and 282. 18.11 (b) The conveyance must be in a form approved by the 18.12 attorney general and must provide that the land reverts to the 18.13 state if it is not used for public airport purposes. The 18.14 conveyance must reserve an easement to ensure public access and 18.15 state management access to the public and private lands to the 18.16 west and south. The attorney general may make necessary changes 18.17 in the legal description to correct errors and ensure accuracy. 18.18 The consideration for the conveyance must not be less than the 18.19 appraised value of the land and timber and any survey costs. 18.20 Proceeds shall be disposed of according to Minnesota Statutes, 18.21 chapter 84A. The attorney general may make 19.6 necessary changes in the legal description to correct errors and 19.7 ensure accuracy. 19.8 (c) The land and buildings of the Ah-Gwah-Ching property 19.9 that may be conveyed to Cass county or a regional jail authority 19.10 are located in that part of the South Half, Section 35, Township 19.11 142 North, Range 31 West and that part of Government Lot 6, 19.12 Section 2, Township 141 North, Range 31 West, in Cass county, 19.13 depicted on the certificate of survey prepared by Landecker and 19.14 Associates, Inc. dated April 25, 2002. During the term 20.11 of the lease, the state shall be responsible for any and all 20.12 maintenance and repairs the state determines are necessary for 20.13 its use of the leased space. 20.14 Sec. 18. [PRIVATE SALE OF SURPLUS LAND BORDERING PUBLIC 26.24 WATERS; SCOTT COUNTY.] 26.25 (a) Notwithstanding Minnesota Statutes, sections 92.45; 26.26 94.09; 94.10; 97A.135, subdivision 2a; and 103F.535, the 26.27 commissioner of natural resources shall sell by private sale the 26.28 surplus land bordering public waters that is described in 26.29 paragraph (e). 26.30 (b) The conveyance shall be in a form approved by the 26.31 attorney general for consideration of no less than the appraised 26.32 value of the land. 26.33 (c) The deed must contain a restrictive covenant that 26.34 prohibits altering, disturbing vegetation in, draining, filling, 26.35 or placing any material or structure of any kind on or in the 26.36 existing wetland area located on the land; prohibits any 27.1 increase in run-off rate or volume from the land or future 27.2 buildings into said wetland; and prohibits diverting or 27.3 appropriating water from said wetland. 27.4 (d) The consideration received for the conveyance shall be 27.5 deposited in the state treasury and credited to the wildlife 27.6 acquisition account in the game and fish fund. The money is 27.7 appropriated to the commissioner of natural resources for 27.8 wildlife land acquisition purposes. 27.9 (e) The land that may be sold is in the Prior Lake wildlife 27.10 management area in Scott county and is described as: 27.11 The East 1200 feet of the South 800 feet of the Southwest 27.12 Quarter of the Southeast Quarter of Section 22, Township 27.13 115 North, Range 22 West. Containing 22 acres, more or less. 27.17 (f) This land no longer fits into the state wildlife 27.18 management area system because of hunting limitations, its small 27.19 size, and future development planned for the area. Proceeds 27.20 from the sale will be used to purchase lands more suitable for 27.21 wildlife management and public use. 27.22 Sec. 26. [PRIVATE SALE OF SURPLUS STATE LAND BORDERING 27.23 PUBLIC WATERS; ST. LOUIS COUNTY.] 27.24 (a) Notwithstanding Minnesota Statutes, sections 92.45, 27.25 94.09, and 94.10, the commissioner of natural resources may sell 27.26 by private sale to adjacent landowners the surplus land 27.27 bordering public waters that is described in paragraph (c). 27.28 (b) The conveyance must be in a form approved by the 27.29 attorney general and the consideration must be equal to the fair 27.30 market value of the land plus the cost of appraisal. 27.31 (c) The land to be sold is in St. Louis county and is a 27.32 parcel of land to be split from Government Lot 5, Section 1, 27.33 Township 67 North, Range 17 West. The exact area to be sold 27.34 will be determined by completion of a further site analysis. 27.35 (d) The conveyance is necessary for installation of a 27.36 community septic system to benefit the adjacent land owners in 28.1 Government Lot 6, Section 1, Township 67 North, Range 17 West. 28.2 (e) The commissioner has determined that the parcel needed 28.3 for the purpose described in paragraph (d) is available for 28.4 surplus, will not be necessary for natural resources purposes, 28.5 and is best suited for the above-stated purpose. 28.6 Sec. 27. [PUBLIC OR PRIVATE SALE OF TAX-FORFEITED LAND 28.7 BORDERING PUBLIC WATER; ST. LOUIS COUNTY.] 28.8 (a) Notwithstanding Minnesota Statutes, sections 92.45 and 28.9 282.018, subdivision 1, and the public sale provisions of 28.10 Minnesota Statutes, chapter 282, St. Louis county may sell by 28.11 public or private sale the tax-forfeited land bordering public 28.12 water that is described in paragraph (c), under the remaining 28.13 provisions of Minnesota Statutes, chapter 282. 28.14 (b) The conveyance must be in a form approved by the 28.15 attorney general for a consideration of taxes due on the 28.16 property and any penalties, interest, and costs. [LAND EXCHANGE; LAKE OF THE WOODS COUNTY.] 30.7 (a) Notwithstanding Minnesota Statutes, sections 94.342, 30.8 subdivision 3, and 94.343, subdivision 3, the commissioner of 30.9 natural resources shall, with the approval of the land exchange 30.10 board as required under the Minnesota Constitution, article XI, 30.11 section 10, and according to the remaining provisions of 30.12 Minnesota Statutes, sections 94.342 to 94.348, exchange the 30.13 following land bordering on public waters for the land described 30.14 in paragraph (b): the North 859.83 feet of the Southwest 30.15 Quarter of the Southwest Quarter and the North 859.83 feet of 30.16 Government Lot 7, Section 5, Township 167 North, Range 33 West. 30.17 (b) The land bordering on public waters to be obtained by 30.18 the commissioner in the exchange under paragraph (a) is 30.19 described as: the Northeast Quarter of the Southwest Quarter, 30.20 Section 5, Township 167 North, Range 33 West. 30.21 Sec. 31. [LAND EXCHANGE; ST. LOUIS COUNTY.] 30.22 Subdivision 1. [EXCHANGE REQUIRED.] The commissioner of 30.23 natural resources shall exchange, according to Laws 1998, 30.24 chapter 389, article 16, section 31, as amended by Laws 1999, 30.25 chapter 184, Laws 2000, chapter 488, article 3, section 31, and 30.26 Laws 2001, chapter 164, section 5, the following trust fund land 30.27 in St. Louis county: Lot 11, Block 1 of Lake Leander Homesite 30.28 Plat No. 1, Section 16, Township 60 North, Range 19 West, for 30.29 county land. 30.30 Subd. 2. [DEADLINE.] The exchange required under 30.31 subdivision 1 must be completed by June 30, 2004. 30.32 Sec. 32. [CONVEYANCE OF LAND; COOK COUNTY.] 30.33 (a) Notwithstanding Minnesota Statutes, sections 92.45, 30.34 94.09 to 94.16, 161.144, or any other law, the commissioner of 30.35 transportation shall convey to Cook county for no consideration 30.36 the land bordering public water that is described in paragraph 31.1 (c). The commissioner may not convey the land until Cook county 31.2 enters into an agreement with the commissioner of transportation 31.3 to spend an amount equal to the value of the land described in 31.4 paragraph (c) for airport purposes. [PRIVATE SALE OF COUNTY LAND; WADENA COUNTY.] 32.15 (a) Notwithstanding the public sale provisions of Minnesota 32.16 Statutes, section 373.01, subdivision 1, Wadena county may sell 32.17 by private sale to the commissioner of natural resources lands 32.18 described in paragraph (c). 32.19 (b) The conveyance must be in a form approved by the 32.20 attorney general for a consideration of the appraised value of 32.21 the land. 32.22 (c) The land to be sold is located in Wadena county and is 32.23 described as the South Half of the Southeast Quarter of Section 32.24 32, Township 138 North, Range 33 West. 32.25 Sec. 34. [FLOOD HAZARD MITIGATION GRANTS; PARTIAL 32.26 COMPLETION OF PROJECTS.] 32.27 The commissioner of natural resources may allocate money 32.28 for the flood hazard mitigation grants from the appropriation in 32.29 Laws 2002, chapter 393, section 7, subdivision 20, as amended by 32.30 Laws 2002, First Special Session chapter 1, section 12, for 32.31 partial construction of projects, notwithstanding that the 32.32 projects will not be completed until an additional appropriation 32.33 is made, and notwithstanding Minnesota Statutes, section 16B.31, 32.34 subdivision 2. 32.35 Sec. 35. [EFFECTIVE DATE.] 32.36 Sections 13, 17, 18, 31, and 34 are effective the day 33.1 following final enactment.
