  1.1                          A bill for an act 
  1.2             relating to crimes; defining the level of negligence 
  1.3             required for the crime of causing negligent fires; 
  1.4             amending Minnesota Statutes 2000, section 609.576, 
  1.5             subdivision 1.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 609.576, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [NEGLIGENT FIRE RESULTING IN INJURY OR 
  1.10  PROPERTY DAMAGE.] Whoever is culpably grossly negligent in 
  1.11  causing a fire to burn or get out of control thereby causing 
  1.12  damage or injury to another, and as a result thereof: 
  1.13     (a) a human being is injured and great bodily harm 
  1.14  incurred, is guilty of a crime and may be sentenced to 
  1.15  imprisonment of not more than five years or to payment of a fine 
  1.16  of not more than $10,000, or both; or 
  1.17     (b) property of another is injured, thereby, is guilty of a 
  1.18  crime and may be sentenced as follows: 
  1.19     (1) to imprisonment for not more than 90 days or to payment 
  1.20  of a fine of not more than $700, or both, if the value of the 
  1.21  property damage is under $300; 
  1.22     (2) to imprisonment for not more than one year, or to 
  1.23  payment of a fine of $3,000, or both, if the value of the 
  1.24  property damaged is at least $300 but is less than $2,500; 
  1.25     (3) to imprisonment for not more than three years, or to 
  2.1   payment of a fine of not more than $5,000, or both, if the value 
  2.2   of the property damaged is $2,500 or more. 
  2.3      Sec. 2.  [EFFECTIVE DATE.] 
  2.4      Section 1 is effective August 1, 2001, and applies to 
  2.5   crimes committed on or after that date.
