A bill for an act
relating to education; providing for licensed student services personnel aid;
appropriating money; proposing coding for new law in Minnesota Statutes,
chapter 124D.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Purpose. new text end

new text begin (a) The purpose of licensed student services personnel aid
is to improve student educational achievement; safety; and physical, emotional, and social
well-being by providing comprehensive access to needed licensed student support services.

new text begin (b) For the purposes of this section, "licensed student services personnel" means
licensed school counselors, licensed school nurses, licensed school social workers,
licensed school psychologists, and licensed alcohol and chemical dependency counselors.

new text begin (a) A school district may apply for aid for licensed student services
personnel newly hired after the 2006-2007 school year. The aid must be used only for
the salary and benefit costs of new licensed student services personnel positions. The
aid may not be used to:

new text begin (1) substitute or replace licensed student services positions that existed at the start
of the 2006-2007 school year; or
new text end

new text begin (2) hire new student services personnel funded through private sources.

new text begin (b) To be eligible for aid, a school district annually by October 1 must report to
the department its total estimated salary and benefit cost for licensed student services
personnel for the current fiscal year and its total salary and benefit cost for licensed student
services personnel for fiscal year 2007. The licensed student services personnel aid equals
the greater of zero or 50 percent of the difference between the current year's estimated
salary and benefit cost and the adjusted salary and benefit cost for the previous fiscal
year. A district's adjusted salary and benefit cost for fiscal year 2008 equals the salary
and benefit expenses spent on licensed student services personnel for fiscal year 2007.
For fiscal year 2009 and later, the district's adjusted salary and benefit cost equals the
adjusted salary and benefit cost for the previous year times the sum of one plus the annual
percentage increase in the district's total package salary and benefit settlement for that year.

Sec. 2. new text begin APPROPRIATION.

new text begin $....... in fiscal year 2008 and $....... in fiscal year 2009 are appropriated from the
general fund to the commissioner of education for licensed student services personnel
aid under section 1. The commissioner shall make aid payments only to the extent that
appropriated funds are available.
