A bill for an act
relating to insurance; clarifying the definition of health carrier; amending
Minnesota Statutes 2008, section 62A.011, subdivision 2.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 62A.011, subdivision 2, is amended to read:


Subd. 2.

Health carrier.

"Health carrier" means an insurance company licensed
under chapter 60A to offer, sell, or issue a policy of accident and sickness insurance as
defined in section 62A.01; a nonprofit health service plan corporation operating under
chapter 62C; a health maintenance organization operating under chapter 62D; a fraternal
benefit society operating under chapter 64B; or a joint self-insurance employee health plan
operating under chapter 62H. new text begin Health carrier does not include an insurance company or
other entity included in this subdivision that offers, sells, issues, or renews only products
that are expressly excluded from the definition of a health plan under subdivision 3, except
in the context of a law that expressly references one of those products.
