  1.1                          A bill for an act 
  1.2             relating to government data practices; providing for 
  1.3             classification of certain data; amending Minnesota 
  1.4             Statutes 2002, section 13.643, by adding a 
  1.5             subdivision; proposing coding for new law in Minnesota 
  1.6             Statutes, chapter 13. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [13.3215] [UNIVERSITY OF MINNESOTA DATA.] 
  1.9      Claims experience and all related information received from 
  1.10  carriers and claims administrators participating in a University 
  1.11  of Minnesota group health, dental, life, or insurance disability 
  1.12  plan or the University of Minnesota workers' compensation 
  1.13  program, and survey information collected from employees or 
  1.14  students participating in these plans and programs, except when 
  1.15  the university determines that release of the data will not be 
  1.16  detrimental to the plan or program, are classified as nonpublic 
  1.17  data not on individuals pursuant to section 13.02, subdivision 9.
  1.18     Sec. 2.  Minnesota Statutes 2002, section 13.643, is 
  1.19  amended by adding a subdivision to read: 
  1.20     Subd. 5.  [DATA RECEIVED FROM FEDERAL GOVERNMENT.] All data 
  1.21  received by the department of agriculture from the United States 
  1.22  Department of Health and Human Services, the Food and Drug 
  1.23  Administration, and the Agriculture, Food Safety, and Inspection 
  1.24  Service for the purpose of carrying out the department of 
  1.25  agriculture's statutory food safety regulatory and enforcement 
  1.26  duties are classified as nonpublic data under section 13.02, 
  2.1   subdivision 9, and private data on individuals under section 
  2.2   13.02, subdivision 12.
