  1.1                          A bill for an act 
  1.2             relating to liquor; modifying a posting requirement; 
  1.3             authorizing the cities of Blaine, Elko, Hastings, 
  1.4             Maple Grove, Minneapolis, Sartell, St. Michael, St. 
  1.5             Paul, Thief River Falls, Waconia, and Woodbury to 
  1.6             issue certain licenses; amending Minnesota Statutes 
  1.7             2002, sections 340A.318, subdivision 3; 340A.404, 
  1.8             subdivision 2. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2002, section 340A.318, 
  1.11  subdivision 3, is amended to read: 
  1.12     Subd. 3.  [POSTING; NOTICE.] Verified lists or statements 
  1.13  required by subdivision 2 shall be posted by the commissioner in 
  1.14  offices of the department in places available for public 
  1.15  inspection not later than the day Monday following receipt.  
  1.16  Documents posted shall constitute notice to every distiller, 
  1.17  manufacturer, or wholesaler of the information posted.  Actual 
  1.18  notice, however received, also constitutes notice. 
  1.19     Sec. 2.  Minnesota Statutes 2002, section 340A.404, 
  1.20  subdivision 2, is amended to read: 
  1.21     Subd. 2.  [SPECIAL PROVISION; CITY OF MINNEAPOLIS.] (a) The 
  1.22  city of Minneapolis may issue an on-sale intoxicating liquor 
  1.23  license to the Guthrie Theater, the Cricket Theatre, the Orpheum 
  1.24  Theatre, and the State Theatre, and the Historic Pantages 
  1.25  Theatre, notwithstanding the limitations of law, or local 
  1.26  ordinance, or charter provision relating to zoning or school or 
  1.27  church distances.  The licenses authorize sales on all days of 
  2.1   the week to holders of tickets for performances presented by the 
  2.2   theaters and to members of the nonprofit corporations holding 
  2.3   the licenses and to their guests. 
  2.4      (b) The city of Minneapolis may issue an intoxicating 
  2.5   liquor license to 510 Groveland Associates, a Minnesota 
  2.6   cooperative, for use by a restaurant on the premises owned by 
  2.7   510 Groveland Associates, notwithstanding limitations of law, or 
  2.8   local ordinance, or charter provision. 
  2.9      (c) The city of Minneapolis may issue an on-sale 
  2.10  intoxicating liquor license to Zuhrah Shrine Temple for use on 
  2.11  the premises owned by Zuhrah Shrine Temple at 2540 Park Avenue 
  2.12  South in Minneapolis, and to the American Swedish Institute for 
  2.13  use on the premises owned by the American Swedish Institute at 
  2.14  2600 Park Avenue South, notwithstanding limitations of law, or 
  2.15  local ordinances, or charter provision relating to zoning or 
  2.16  school or church distances. 
  2.17     (d) The city of Minneapolis may issue an on-sale 
  2.18  intoxicating liquor license to the American Association of 
  2.19  University Women, Minneapolis branch, for use on the premises 
  2.20  owned by the American Association of University Women, 
  2.21  Minneapolis branch, at 2115 Stevens Avenue South in Minneapolis, 
  2.22  notwithstanding limitations of law, or local ordinances, or 
  2.23  charter provisions relating to zoning or school or church 
  2.24  distances. 
  2.25     (e) The city of Minneapolis may issue an on-sale wine 
  2.26  license and an on-sale 3.2 percent malt liquor license to a 
  2.27  restaurant located at 5000 Penn Avenue South, and an on-sale 
  2.28  wine license and an on-sale malt liquor license to a restaurant 
  2.29  located at 1931 Nicollet Avenue South, notwithstanding any law 
  2.30  or local ordinance or charter provision. 
  2.31     (f) The city of Minneapolis may issue an on-sale wine 
  2.32  license and an on-sale malt liquor license to the Brave New 
  2.33  Workshop Theatre located at 3001 Hennepin Avenue South, the 
  2.34  Theatre de la Jeune Lune, the Illusion Theatre Theater located 
  2.35  at 528 Hennepin Avenue South, the Hollywood Theatre located at 
  2.36  2815 Johnson Street Northeast, the Loring Playhouse located at 
  3.1   1633 Hennepin Avenue South, and the Jungle Theater located at 
  3.2   2951 Lyndale Avenue South, the Brave New Institute located at 
  3.3   2605 Hennepin Avenue South, the Guthrie Lab located at 700 North 
  3.4   First Street, and the Southern Theatre located at 1420 
  3.5   Washington Avenue South, notwithstanding any law or local 
  3.6   ordinance or charter provision.  The license authorizes sales on 
  3.7   all days of the week. 
  3.8      (g) The city of Minneapolis may issue an on-sale 
  3.9   intoxicating liquor license to University Gateway Corporation, a 
  3.10  Minnesota nonprofit corporation, for use by a restaurant or 
  3.11  catering operator at the building owned and operated by the 
  3.12  University Gateway Corporation on the University of Minnesota 
  3.13  campus, notwithstanding limitations of law, or local ordinance 
  3.14  or charter provision.  The license authorizes sales on all days 
  3.15  of the week. 
  3.16     Sec. 3.  [CITY OF BLAINE; LIQUOR LICENSES.] 
  3.17     The city of Blaine may issue 15 on-sale intoxicating liquor 
  3.18  licenses in addition to the number authorized by law.  All 
  3.19  provisions of Minnesota Statutes, chapter 340A, not inconsistent 
  3.20  with this section, apply to the licenses authorized by this 
  3.21  section. 
  3.22     Sec. 4.  [ELKO SPEEDWAY; ON-SALE LICENSE.] 
  3.23     Notwithstanding Minnesota Statutes, section 340A.404, 
  3.24  subdivision 1, the city of Elko may issue an on-sale 
  3.25  intoxicating liquor license to the Elko Speedway in addition to 
  3.26  the number authorized by law.  The license may authorize sales 
  3.27  only to persons attending racing events at the speedway.  All 
  3.28  provisions of Minnesota Statutes, chapter 340A, not inconsistent 
  3.29  with this provision, apply to the license authorized under this 
  3.30  section.  The license may be issued for a space that is not 
  3.31  compact and contiguous, provided that the licensed premises may 
  3.32  include only the space within the fenced grandstand area as 
  3.33  described in the approved license application.  
  3.34     Sec. 5.  [CITY OF HASTINGS; ON-SALE LICENSES.] 
  3.35     The city of Hastings may issue three on-sale intoxicating 
  3.36  liquor licenses in addition to the number authorized by law.  
  4.1   All provisions of Minnesota Statutes, chapter 340A, not 
  4.2   inconsistent with this section, apply to the licenses authorized 
  4.3   by this section. 
  4.4      Sec. 6.  [CITY OF MAPLE GROVE; ON-SALE LICENSES.] 
  4.5      The city of Maple Grove may issue 12 on-sale intoxicating 
  4.6   liquor licenses in addition to the number authorized by law.  
  4.7   All provisions of Minnesota Statutes, chapter 340A, not 
  4.8   inconsistent with this section, apply to the licenses authorized 
  4.9   under this section. 
  4.10     Sec. 7.  [CITY OF SARTELL; ON-SALE LICENSES.] 
  4.11     The city of Sartell may issue five on-sale intoxicating 
  4.12  liquor licenses in addition to the number authorized by law.  
  4.13  All provisions of Minnesota Statutes, chapter 340A, not 
  4.14  inconsistent with this section, apply to the licenses authorized 
  4.15  by this section. 
  4.16     Sec. 8.  [CITY OF ST. MICHAEL; ON-SALE LICENSES.] 
  4.17     The city of St. Michael may issue five on-sale liquor 
  4.18  licenses in addition to the number authorized by law.  All 
  4.19  provisions of Minnesota Statutes, chapter 340A, not inconsistent 
  4.20  with this section, apply to the licenses authorized under this 
  4.21  section. 
  4.22     Sec. 9.  [CITY OF ST. PAUL; STATE FAIR WINE LICENSES.] 
  4.23     (a) Notwithstanding Minnesota Statutes, sections 37.21 and 
  4.24  340A.412, subdivision 4, paragraph (a), clause (3), the city of 
  4.25  St. Paul may issue to the holder of a state fair concessions 
  4.26  contract with the state agricultural society a license 
  4.27  authorizing the licensee to sell Minnesota-produced wine by the 
  4.28  glass at the state fair in connection with the concessionaire's 
  4.29  sale of food.  All provisions of Minnesota Statutes, chapter 
  4.30  340A, not inconsistent with this section, apply to licenses 
  4.31  issued under this section. 
  4.32     (b) For purposes of this section, "Minnesota-produced wine" 
  4.33  means wine produced by a farm winery licensed under Minnesota 
  4.34  Statutes, section 340A.315, and made from at least 75 percent 
  4.35  Minnesota-grown grapes, grape juices, other fruit bases, or 
  4.36  honey.  
  5.1      Sec. 10.  [CITY OF THIEF RIVER FALLS; LIQUOR LICENSES.] 
  5.2      The city of Thief River Falls may issue two on-sale 
  5.3   intoxicating liquor licenses in addition to the number 
  5.4   authorized by law.  All provisions of Minnesota Statutes, 
  5.5   chapter 340A, not inconsistent with this section apply to the 
  5.6   licenses authorized by this section. 
  5.7      Sec. 11.  [CITY OF WACONIA; LIQUOR LICENSES.] 
  5.8      The city of Waconia may issue three on-sale intoxicating 
  5.9   liquor licenses in addition to the number authorized by law.  
  5.10  All provisions of Minnesota Statutes, chapter 340A, not 
  5.11  inconsistent with this section, apply to the licenses authorized 
  5.12  under this section. 
  5.13     Sec. 12.  [CITY OF WOODBURY; ON-SALE LICENSES.] 
  5.14     The city of Woodbury may issue 12 on-sale intoxicating 
  5.15  liquor licenses in addition to the number authorized by law.  
  5.16  All provisions of Minnesota Statutes, chapter 340A, not 
  5.17  inconsistent with this section, apply to the licenses authorized 
  5.18  by this section. 
  5.19     Sec. 13.  [EFFECTIVE DATE.] 
  5.20     Sections 1 to 12 are effective the day following final 
  5.21  enactment.
