A bill for an act
relating to transportation; expanding impounded vehicle charges to include recovery
and storage of a motor vehicle and its cargo and accident site cleanup; amending
Minnesota Statutes 2020, sections 168B.045; 168B.07, subdivision 1.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 168B.045, is amended to read:


168B.045 TOWED MOTOR VEHICLES.

A person who tows and stores a motor vehicle at the request of a law enforcement officer
shall have a lien on the motor vehicle for the value of the deleted text begin storage anddeleted text end towing and new text begin recovery
of the vehicle and cargo, storage of the vehicle and cargo, and accident site cleanup, and
shall have
new text end the right to retain possession of the motor vehicle new text begin and cargo, subject to the right
to retrieve contents under section 168B.07, subdivision 3,
new text end until the lien is lawfully discharged.
This section does not apply to tows of vehicles parked in violation of snow emergency
regulations.

Sec. 2.

Minnesota Statutes 2020, section 168B.07, subdivision 1, is amended to read:


Subdivision 1.

Payment of charges.

The owner or any lienholder of an impounded
vehicle shall have a right to reclaim such vehicle from the unit of government or impound
lot operator taking it into custody upon payment of all new text begin charges for new text end towing and deleted text begin storage chargesdeleted text end new text begin
recovery of the vehicle and cargo, storage of the vehicle and cargo, and accident site cleanup
new text end
resulting from taking the vehicle new text begin and cargo new text end into custody within 15 or 45 days, as applicable
under section 168B.051, subdivision 1, 1a, or 2, after the date of the notice required by
section 168B.06.
